georgia is on the same trajectory. democrats in georgia want it all this year, and they'll do it again. the only chance republicans have in the long term is to become viable in the arena of ideas and fight for votes fair and square. republicans' severe voting restrictions might slow down the progress, but it's not going to stop it. joining us now is charniele herring, majority leader of the virginia house of delegates and former chair of the democratic party of virginia. and jonathan capehart, opinion writer for "the washington post" and host on msnbc. good morning to both of you. thank you for being with us. leader herring, being the leader of the former chair of the democratic party in virginia, used to sort of be a side show. it wasn't really a thing. it was a party in the wilderness for a long time. you have been part of a change in the state of virginia that 15 years ago people wouldn't have thought possible. >> absolutely. it has been an incredible journey. but what was key is that we did not lose our values. we

and that happened in georgia. there has been a change in law, in the election process in georgia. does that mean that you are going to need a cushion on top of a cushion? a number that is too big for them to cheat? >> i get this question all the time. i'm here on this monday, it is literally five weeks until the georgia legislature, the arizona legislature, and so many other states legislatures, come back into session. and they have plans to do more voter fraud conspiracies around fraud and all kinds of maga faction ideas. this is not about that issue, we need the freedom to vote act, we need this passed by the congress as soon as possible. in six weeks, from today. more states are reconvening and we still have not had congressional action. voters, they demand their democracy function. so we are not going to let them break the game. yes, you are correct, all these bills are passing, and they're going to come back and pass more. so we are going to keep fighting those bills. but this is clear, congress must act. we must have a functioning democracy. and to your question on campaign

within georgia law. and they were rattling off these things that don't exist, some of these statutes are different from state to say. and obviously as you know, we kept hearing about them, and kept looking at them, we kept saying while these laws in georgia are very solid protective lines around the voting process. >> well that's exactly right, and there's a reason why it's so important that there are state level laws like this. obviously in our federal system of government, the federal law is what it is. there are powerful bases, compelling bases, for the justice department to investigate a significant amount of what happened surrounding the 2020 presidential election, and obviously there's a select committee in the house that's doing that to. but under our constitutional system, states actually have the primary role. in carrying out presidential elections. the federal government hardly has much of a role at all. and it's really congress, not the president that has a role. mainly certifying the electora

georgia has 159 counties. and the thing you need to know about georgia for the national audience is that, sure, there are republican leaning counties and democratic leaning counties. but even in our very deep red, for example, north georgia counties where president trump was tonight, we've got democrats in those counties. and so we'll be looking in both small, medium, and large counties no matter their overall partisanship. we're going to be looking at the vote numbers for democratic leaning groups in those rural counties as well as throughout south georgia where there's a lots of micropolitan, african-american towns and real diverse communities in south georgia and metro atlanta. this is not one county. this isn't like my home county in ohio. i'll be looking at southwest georgia down in albany and that whole region of the state. that's a really important area, savannah, where vp-elect harris was and obviously metro atlanta we'll be keeping a close eye on. >> we have slammed up against the clock. lauren, thank

that georgia conversation was part of an ongoing effort by the president, again, to corrupt the results of the election, to maintain power by casting doubt on the results of the election, even though they were all certified by all 50 states and accepted by all of the election officials. this was an effort by the president to feed lie to his supporters to the point that they became enraged and violent. they came to washington at his urging for the stop-the-steal rally, again promoting the story that he had won and i think just more evidence of his efforts to hold on to power no matter, which is why his conduct is so serious and rises to the level of high crimes and misdemeanors because it is a fundamental attack on our democracy, on our peaceful transition of power which is a cornerstone of american democracy, and it was an incitement of serious violence during the meeting of the electoral college in an effort to stop that proceeding. he delayed it for a bit. he didn't stop it. we came back and did our work, but that was the result of the violent attack on the capitol incited by the pres

attorney in georgia. you didn't believe on its face that it was just needed to spend more time with the family. it turns out this reporting proves you right about that. i re-read georgia's statute tonight on voter fraud and solicitation of voter fraud. it seems to me like the georgia statute is violated in the evidence we're reading in "the new york times." >> yeah. i don't think there's any doubt that there's a problem with the violation of the georgia statute. i mean, it is pretty clear here that there's been an effort to solicit somebody to commit voter fraud. i think it also puts the meat on the bones of why the u.s. attorney in atlanta resigned, and i felt like all along he was likely asked to do something he didn't think was appropriate, and that's what it looks to be now. i am not -- you know, the administration is gone. we are dealing with actings now, but, this is sort of the classic example. while the last bird may be gone, you just can't get the stink out of the chicken house. that's really wha

you're our expert on georgia law. what does it mean to you that the secretary of state's office is now investigating this case? >> you know, i was glad to see them announce an investigation, but i've really got some concerns about the appearance of the investigation, and let me give you an example. one thing a prosecutor wants to do in any case is to sort of remove any taint of a conflict of interest. and so i'm not sure how wise it is for the secretary of state, who is a key and material witness in the case, to investigate it. if you just think about it like this. let's say you're in the first national bank and a bank robber comes in and he says, i need $11,780, and he goes by the bank manager's office, and he talks to him for an hour and threatens him, staying bad things are going to happen if you don't give me the $11,780 and he runs out of the bank. you certainly don't want the bank people and the employees at the bank investigating that. so there are other mechanisms under georgia law instead of -- such as referr

bill it was the model for what they did in georgia, they started replicating it around the. country and as you, said there are a lot of horrible provisions in this bill. they are precision targeted to make it harder for people of color to vote. and one body of this body, one part of this, bill is really around the counting the votes and the, who has the power round vote election registration. we see this in other states as. well but georgia is the first state to really take the steps where the republican gerrymandered legislature in georgia gave itself, through this, bill new powers to control election administration in the state. so any republican legislation in the county canned suit initiated process. but here's how i would think about this, what's going on in georgia and around the country, as we are moving from a trump strongman election subversion, he was calling all over the country to try to flip election results. trump himself was strong army in state legislatures in michigan, he was the strongman. they have now weaponized through a appointments of republican partie

now with this georgia law, they would be able to do that. this attack is part of a much wider and ominous stories about attacks on election officials across the country. >> are you concerned about what these past threats against election workers could mean for polling places during the 2022 midterms and beyond? >> yes. we're very concerned about it. again this is what we have been saying all along. this is why some of the newer aspects of the criminal vote act, which was actually added in for the people act. it wasn't there originally. after this year of the attacks there's built in to the most recent legislation protections for election officials. we're very concerned about it. at the end of the day what we know is there's a thing about out organizing the voter suppression. we can do everything right on our side. go out and we can touch all the voters multiple times and have persuasive messages and get the votes out. at the end of the day even if we over come the other stuff and voter id and the attacks on vote by mail and all that stuff th

he's a former district attorney for the macon judicial circuit in georgia. what does this add to what fawn ae willis is presenting already to a fulton county jury? >> i think the point is it just paints another portrait of the continued effort of him trying to change the result. and i think it's important that we don't get hung up on just this phone call but we see how it fits into the larger picture. and that's what's important about a racketeering indictment is that if she were to bring racketeering as what referenced in her letter to governor, then the jury would hear multiple pieces of the puzzle and put them all together to get a more clearer picture of what went on. >> one of the other things that's mentioned, these different counts that she's investigating that's mentioned in her letter is making false statements to state and local government bodies. did we not just hear donald trump making false statements to a government official? >> i'm not aware of any evidence that substantiates the claims that the former president just made on that phone call, b

georgia, those two senators from georgia are the first senators in american history where the black people made up a majority of the coalition that put them into office. and it was also the first time at least since reconstruction that the majority of a coalition delivered a state for a presidential candidate were black. that's what power looks like. that's the power of the reverse migration. because the last time that georgia went for a democratic candidate was 1992. and in 1992 only 25% of the population of georgia was black. this year, 33% of the population of georgia was black. the black population of georgia doubled from 1990 to 2020, so on the one hand you had amazing organizing by a bunch of groups including stacey abrams, who is a superwoman. but on the other hand they had more bodies to organize. and that becomes the proof in concept of what returning to the south, establishing black power in states where you're already a large percentage of the population, changes the political dynamic of america completely. if the great migration had never happened, black people could control up

what happened in georgia today was not justice. justice would be if ahmaud arbery were still alive tonight, getting ready to celebrate thanksgiving with his family. what happened in georgia today was accountability. the three men who chased and gunned down 25-year-old ahmaud arbery while he was jogging in february of of last year have all been found guilty of murder. celebrations erupted outside the courthouse after the nearly all-white jury delivered a guilty verdict after 11 hours of deliberation. travis mcmichael, who fatally shot ahmaud arbery, was found guilty on all nine counts including malice murder and felony murder. his father, gregory mcmichael, and their neighbor william bryan were also found guilty of felony murder. they each face a sentence of life in prison. it will be up to the judge to decide if they will ever be eligible for parole. they all still face federal hate crime charges as well. ahmaud arbery's parents thanked those who've marched, prayed, and supported their family since their son's murder. >> we -- >> i
