let's get right to our chief legal analyst dan abrams tonight. dan, the reactions to this trial, as polarized as the country is, people have had very strong reactions on both sides of the case. was there any one thing that you can point to that could have been a turning point for the jury? >> i think it was the videos of the incidents. in a typical case like this, when the defendant takes the witness stand, it all comes down to that person's credibility, but here the jurors could evaluate for themselves what happened. they actually asked in the jury deliberation process to see those videos again. and i think that made all the difference here. remember, they were not deciding here, who do they believe more. they were deciding a very specific legal question -- do they think that the prosecutors proved beyond a reasonable doubt that it wasn't self-defense? and i think those videos made a big difference. >> dan abrams and terry moran with us tonight. dan, our thanks to you as well. >>> now to the other major headline breaking a short time ago. tonigh

let's get right to abc's chief legal analyst dan abrams. and dan, two of the defendants, greg mcmichael and william bryan, were not found guilty of the most serious charge, malice murder. but travis mcmichael was. could you explain those differences between the verdicts? >> yeah, the jurors basically assigned slightly different blame to the different defendants. travis mcmichael not only chased down ahmaud arbery, but he also was the one who shot and killed him. he was convicted of all the charges including the highest, malice murder. greg mcmichael, his dad, who was involved in chasing down arbery, came armed but didn't end up shooting him, was not convicted of that single count of malice murder, but of all the rest, including all the felony murder changes. and william bryan, the friend who was behind them, convicted of all the felony murder charges except for one, because apparently the jurors didn't believe that he was specifically responsible for an aggravated assault involving the shotgun. >> and dan, the legal issues are not over for

we're going to bring in abc news chief legal analyst dan abrams. dan, how important are these lesser included charges? >> they're very important. they allow the jury to compromise on particularly where prosecutors have been having the most difficulty. the single most important thing that the judge did is sort of peripheral to those lesser include includeds. it's that he's going to read a provocation charge. he's allowing the jury to say if you believe kyle rittenhouse provoked this, then that's going to make self-defense very hard for you to invoke, meaning he's going to then have to show that he exhausted every other possible opportunity before doing it. that is a very important instruction the jury is going to get. >> could that be why the defense agreed to these lesser charges? >> i think there are two reasons here. number one, i don't think the defense is as confident as many people outside the courtroom are. that there's going to be an all-out acquittal. number two, the most important thing to them is they don't want another trial. typically a

. >>> let's bring in our chief legal analyst dan abrams and, dan, the trial is already raised major issues. we heard what the judge said when it comes to makeup of the jury. ahmaud arbery's family says it's just another injustice. what do you make of that? >> look, you can understand why they're upset. anyone who says that this is not a case about race, i think, is living in a fantasy world. as a legal matter, when you're talking about the jury here, issue number one, the defense is allowed to strike prospective jurors for almost any reason they want except race. so what happened is, they went forward and explained various reasons why they dismissed all these people, which were not racially based. the judge basically saying, i don't really believe that, but maybe it doesn't cross that legal line. number two is, that the jury pd to reflect the exact percentage of jurors who are of that particular race in a community and the third thing is, and i think this is something not being discussed enough, there were a good number of black prospective jurors who were honest in the jury selection proc

we bring in our abc news legal analyst, dan abrams. there's a lot to unpack here. your reaction to rittenhouse taking the stand? >> his attorney promised he would take the witness stand so we expected him to take the stand. people started to wonder because the case has not been going well for prosecutors so some started to question, well, maybe he doesn't need to take the stand at all. look, he didn't hurt himself. he didn't come across as arrogant. whether you believe his tears or not -- and that's the big debate. people watched that and some people say i think those were phony tears. others say i think it was real. it almost doesn't matter because it's about all the other facts of the case in conjunction with exactly what he's saying happened and, remember, the prosecution has the burden here to effectively disprove this beyond a reasonable doubt and you have to keep that in mind when evaluating what may happen here about that burden for the prosecution. >> and you say that some of the prosecution's own witnesses may have actually helped the defense. so what is t

we bring in our abc news chief legal analyst dan abrams. and, dan, your thought initials as we begin the second day of deliberations? >> if there have been a verdict yesterday and if we heard the word verdict yesterday, i think it would have been good news for kyle rittenhouse. it would have meant i think that they had gone through very quickly the charges and determined, you know, we don't even need to get into this too much it's clear there was self-defense. the fact they're going into day two at the very least means they're taking their time, they're evaluating and assessing the law and the facts. >> more copies of the jury instructions. what do you take from that? >> this isn't a case about exactly what happened. it's a question about why and it's a question about the law and those jury instructions are the whole case. i mean, this case is about the law, right? it's about how do you interpret the law based on the fact that -- we have videos of what happened. we saw it happen. so now the question is, how do i interpret everything that ha

>>> we'll bring in abc news chief legal analyst dan abrams. happy thanksgiving, dan. i keep thinking of that image of ahmaud's father in the courtroom and the emotion you saw after those 11 hours of jury deliberations. were you surprised by anything in this verdict? >> not really. i think that the verdict was actually pretty quick, meaning when you think about the fact you're talking about a 14-day trial, you're talking about three defendants and nine charges. the fact that they came back in basically a day tells you that there wasn't a lot of dissension on that jury either about this verdict. >> guilty of 23 of 27 counts, if you could take us through the different verdicts and why the jury decided the way it did. >> i think they basically assessed culpability and said travis mcmichael who is the one who fired the weapon was the most culpable, convicted of malice murder and all the other charges. greg mcmichael, the son convicted of 8 of the 9. he was the one who initiated the event but didn't actually pull the trigger. then william bryan, the guy who was in the back,

we'll bring in our chief legal analyst dan abrams. big picture, what stands out to you the most in this case? >> how many warning signs there were. you have had travis scott arrested twice before for disorderly conduct, for encouraging fans at concerts to cross the barriers, come up on stage, move forward, et cetera. you have 2015 in chicago, 2017 in arkansas. weeks later in new york, a fan is injured, partially paralyzed at a concert. 2019 at this very event, you had three people injured, and then at this event in this year, there are videos out there of people breaking down the security barriers earlier in the day. now in order to cross the line though into criminal conduct, level of recklessness on his part at the concert i think itself or in the planning of it or in something that he says. >> what does he have to see? what does he have to be told? >> so he being travis scott? >> travis scott, to establish recklessness. >> right. so i think there's comments that he makes at the concert about rage on. i want to see some rages. it de
