i mean, consider the fact that the cosby trial went five days and then it had a hung jury. phil specter at his first trial went 12 days and ended up hung jury. menendez three days and hung jury. conversely paul manafort was convicted after four days. so it's hard to say that the length of time is really that telling. a lot of things can be happening. one thing that has not clearly happened is that the defense did a good job is showing how these counts of a cascading failure. once you decide he acted in self-defense, with regard to rosenbaum, they did a good job in saying well then you have got to discount this count and they went through them. that clearly hasn't happened. they probably could have done that right off. but, it can be that they reached an agreement on some counts and they have dead locked on others. one of the things you sort of look for with a deadlocked jury is if they send out a question that seems more like an intervention question. that it's a try to get the judge to help break things up. sometimes you will see a question like you know, if we find x, sho

joining me now is msnbc legal analyst kristen givens-feden, part of the prosecution team on the bill cosby case. kristen, there are big expectations for this trial, we know, mostly because of the big names that have been associated with jeffrey epstein over the years. the man at the center of this case, we also know, is dead now. so what does that mean for the prosecution's case here? >> it makes it a little more challenging. but keep in mind, if he were alive, he would be facing similar criminal charges and they would likely not be able to call him as a witness. what the prosecution is instead going to focus on is the testimony of the four survivors of epstein and talk about the role, the critical role that maxwell played in terms of enticing them, grooming them, acclimating them to be, quote, you know, comfortable, if you will, to epstein. normalizing sexually explicit behavior, making them comfortable with the sexual acts that epstein committed dependence them. keep in mind, these were minors. so when you have another female there who is approving of the sexually explicit acts, sometime

particular sex acts with these four women that were minors at the time, so unlike, for example the cosby trial or the weinstein trial where we saw a parade of other accusers to come in to establish prior bad acts, i don't expect to see that here. it's unlikely that the judge will allow testimony to go that far into other people, revealing other names, and, again, to your point about the memory being back -- going back to the '80s, you know, the memory expert for the defense, someone that i've actually relied on, her expertise, is going to be fascinating testimony because she's essentially going to come in and say you can't believe everything that these accusers are saying because their memory have distorted because it's been contaminated and her testimony, ana, is very critical in cases that are historical and high profile, you know, going back decades. >> and given that maxwell is being tried essentially as a co coconspirator who died a couple years ago, how could that affect the trial at all? >> they say you're selectively prosecuting her because he's dead and there are other co-conspi
