cleaver: thank you testimony. we know recognize the century foundation. >> good afternoon, chairman cleaver, ranking member hill, and all the members of the subcommittee. thank you for holding this important hearing on exclusionary housing. i am the senior fellow at the century foundation, where i conduct research on housing and education policy. it is my testimony that local zoning policies that prohibit multifamily dwellings are driving up housing prices, fueling racial and economic segregation, and removing the opportunity for millions of families to achieve the american dream. there is much the congress can do to fix this, including adopting a new economic housing act which i will discuss in a moment. i call local exclusionary policies the world we don't see, because they are less visible to the public than other forms of discrimination. most americans today understand that it was wrong for white moms to scream at young black children trying to attend desegregated schools in the south in the 1960's. many of us

. >> well, thank you, chairman cleaver. thanks for convening this hearing. i appreciate the leadership of the chairwoman, and ranking member mchenry as well. four local zoning practices, especially in our largest cities in the country are among the many government regulations that make it more expensive to find a place to live in the united states. in this committee we have heard how housing affordability is ultimate about housing supply. there's simply more people who want to buy a home or rent an apartment than there are homes available. the same applies to the rental market. artificial barriers and certain local zoning policies can make it even more difficult and expensive to build new houses or apartments. impeding the kind of market driven behavior between buy ers and sellers that could help bring the cost of housing down: imposing new government mandates like inclusionary zoning and rent control or increasing federal housing assistance to subsidize down payments doesn't do anything to address the underlying supply/demand imbalance. they just, instead,

joining me is emanuel cleaver of missouri. he's a member of the house financial services and homeland security committees. congressman cleaver, good morning to you. thank you for being with us this morning. i want to ask you first about the arbery verdict. there were a lot of pins and needles, a lot of people on edge about this because despite the overwhelming evidence that suggested this is what people called a modern-day lynching, we are not secure enough in our justice system to know that the right outcome was going to occur. >> that's absolutely right. as it relates to the united states, we should not the least bit be surprised when justice doesn't present itself. our system is still not what it should be and that means that our resistance must be what it must be, which is that we have to continue to fight. i think that arbery's murder was kind of a throwback to my childhood days, frankly. i can remember growing up in texas and hearing my parents talk about things like this, and i, you know, arbery was out and out murdered

for example in the seventh circuit case, cleaver, mr. cleaver, a 58-year-old attorney with considerable corporate law experience, applied for an in-house counsel position. the position required applicants to have no more than seven years of relevant legal experience which effectively means that -- it freezes out job applicants that were over age 40. again, on its face it may look mutual, but no one with more than seven years experience that cuts out a lot of people. despite the significant prior experience in corporate law, cleaver was denied the opportunity to even interview for the job since the experience limit was effectively a proxy for age. the seventh circuit held because mr. cleaver was an outside job applicant rather than employee seeking a new position from within the company, he was barred from bringing a disparate impact claim. this turns the entire purpose of the adea on its head which is to remedy age discrimination for both job seekers and employees. furthermore, we know generalized age discrimination is not isolated. in 2
