. >> on what's next for the former comedian in and out of court, here is nbc's stephanie gosk >> good evening, shep. so bill cosby spent roughly a day in his pennsylvania home before he was off again. we're learning more about the last 24 hours from his long-time spokesperson andrew wyatt who tells us the family knew there was a decision going to be coming from the pennsylvania supreme court. they just didn't know what it was or when exactly it was going to happen. he tells us that cosby was in his cell in a maximum security prison in pennsylvania, that he was actually asleep. the guards came roughly around 12, opened up the cell door and said you're free the pennsylvania supreme court threw out his conviction now the district attorney at the time bruce castor said there was not enough evidence to actually prosecute him at the time. so instead, he said he made a promise that he wasn't going to prosecute so that it would compel cosby to give a deposition in the civil case that constand was filing >> i found another solution to get a positive outcome for the complaining witness. to the

nbc's stephanie gas -- gosk joins us with the breaking details. what do we know? >> reporter: good morning, craig. there are inspections ordered of every 737 this morning. one of the most popular planes in the world. it's based on fears of oxygen levels dropping within the planes and potentially incapacitating crew members including pilots. federal regulators will now require more frequent testing of low cabin pressure warning systems. the faa citing safety concerns and reports of latent failures of the cabin altitude pressure switches. failure of these switches could result in dangerously low oxygen levels inside the cabin potentially causing crews to lose control of the plane. while the directive has been issued for all 737 aircraft, including that troubled 737 max, the faa says it is unrelated to any issues related to the max's return to service last november. >> boy, two follow-up questions really quickly. how far reaching will the order be from the faa, and do we expect this to have any major impact on air travel? >> reporter: that's the big question. for tho

nbc's stephanie gosk has the latest. >> reporter: yesterday it was gymnastics. today it's basketball. a basketball player announced she tested positive for covid and won't be coming here to tokyo. she says she's devastated. another basketball player, zach levine is undergoing covid protocol but they do hopefully expect him to get here later on in the week. the gymnastics team, her family says she's asymptomatic and in a hotel. according to her dad, she's really kind of bored. as an alternate she knew there was a chance she wasn't going to compete, but now of course, her hopes are dashed. her teammate is also in isolation, but she has tested negative. usa gymnastics are sharing some of the details of how they're protecting their athletes, including the fact they're in a separate hotel, they have separate rooms, they eat in a private dining room, they have their own private bathrooms within the facility and the alternates are kept from the six gymnasts who will be competing, those competitions happening sunday. all of this covid news contributing to the attitude h

stephanie gosk is there following all of the changes. the main theme of the opening ceremony that had a lot of great moments, the athletes still looked very happy, was unity and overcoming this global pandemic together. and i'm wondering what it is like there on the ground. >> yes, unity in the face of all of this isolation. it seems like it might be at odds, but so much of this ceremony was defined by this pandemic. and i'm going to get back to the athletes for a moment. that's what it comes down to. they walked into a stadium that fits 68,000 people. these are athletes that were essentially put on ice a year ago and told sorry, we're going to try to do it for you next year and they have moved mountains to put this event on here in japan. and the athletes moved mountains as well. training by themselves, training to get ready for the games, and the beginning of the ceremony was really an ode to their efforts to do that. you saw great images of solitary athletes on treadmills or bikes. and the world coming together to get them to this mom

joining us now nbc's gabe gutierrez in manhattan and stephanie gosk covering the olympics in tokyo. gabe, you've seen the worst of this down south in the southern states for a good part of the year and across the country, as well. now there are local leaders from all parts of the nation including there in new york city taking action to stop the latest spike. >> reporter: yeah. that's right, andrea. mayor bill de blasio in new york city announced that all employees at city-run hospitals like the one behind me, bellevue, will be required to be vaccinated or they'll have to submit a weekly covid test that goes into effect august 2 understand according to the mayor this morning and that is because major cities are trying to get their handle on the highly transmissible delta variant. this comes just weeks after san francisco announced that it would mandate vaccines for all of its city employees there. as we look around the country, andrea, the cdc says 83% of new infections are related to the delta variant. the country right now is averaging more than a thousand new infections every hour

. >> gabe gutierrez is in jacksonville, florida, stephanie gosk in tokyo, geoff bennett at the white house. dylan buyers is the media reporter. and also infectious disease doctor. good to see you all. stephanie, i have to start with you. what a shocker to wake up to. what do we know about the gymnast that tested positive. >> reporter: this is tough news for team usa to kickoff this week. the u.s. gymnastics women, six gymnasts selected to compete. an alternate tested positive. these are young women. we are told another athlete will have to go through additional quarantine measures as a result. the athlete that has covid needs to be isolated in a facility. usa gymnastics confirmed the news. and said the team moved to a separate facility to train and live. that was going to happen anyway, but gives you an idea of the measures they're taking to protect themselves. we saw a number of posts already from some team members, including simone biles on instagram. they are together but all masked. this comes on the heels of the announcement by 17-year-old coco goff that she would not be coming

stephanie gosk has been following this for years and gives this report. >> reporter: the scathing report outlines a string of failures by the fbi including at first not handling the allegations with utmost seriously and urgency they deserved. when usa gymnastics told the field office that multiple gymnasts had made allegation, and that he had lost his job as the team doctor. but the field office conducted limited follow-up and one phone interview and not properly reviewing information in the case. one of the gymnast's mothers told savannah about how frustrated she was. >> i reported it over a year ago and you are the only person from any form of law enforcement who has called me and i said, when did you get this assignment, and he told me yesterday. >> reporter: while the information lagged, he kept his job at michigan state university and a top gymnastics club continuing to abuse minors in his care. in the statement, the fbi calls the report appalling, and that the actions and inactions of bureau employees described are inexcusable and a discredit to the organization, and the agency is

nbc's stephanie gosk has the latest from tokyo. >> reporter: so all of this happened in simone biles' first vault. it's a trick she's done many, many times before, although it's very difficult, this 2 1/2 twisting somersault. instead of doing 2 1/2 twists, she only did 1 1/2, pilling out and landing really awkwardly. later on we were told she's pulling out of the competition tonight, leaving jordan chiles to fill her spot. they went onto the silver medal. we heard there usa gymnastics and they said simone biles had a medical issue and they were going to assess it either the over the coming days. she was asked whether it was a physical condition and she said it wasn't, that it was mostly mental. then we received this statement from the u.s. olympic committee that reads at least in part, we applaud your decision to prioritize your mental wellness over all else and offer you the full support and resources. she is in the all-around competition in the coming days. also the individual pr competition that begins august 1st. it's unclear whether she's going to take part in any of those. simon

stephanie gosk has been covering this for years. is anybody getting punished for this? >> not punishment per se. two agents were mentioned in the inspector general report. you had wj abbott, special agent in charge. he is named. then a supervisoring special agent who was not named. the inspector general referred their name to department of justice but the doj declined to prosecute. abbott retired in 2018 and the fbi saying anyone involved in this in the indianapolis field office has been removed from their position. at the heart of this is the fact that you had an allegation of child sexual abuse brought to a field office for the fbi and they took limited action according to the inspector general, sat on it. had names of gymnasts alleging they were abused by larry nassar, including the olympic star, aly raisman. according to the inspector general, all they did is make a phone call to talk to one of the jim -- jim nass. they may have had jurisdictional issues. they should have notified state and local officials. that wasn't done. he remained in his job. >> any explanatio

joining me now nbc stephanie gosk from outside the cobsy home. hi, steph. this case is marked so many twists and turns and this overturning of the conviction which doesn't deal with the substance of the case at all of andrea constand, you know, testimony about how she was drugged and assaulted. none of that has changed except that the verdict has been overturned and the decision is he can't be reprosecuted. we know we've heard from the prosecutor of the indicate, the second prosecutor who said this should not affect women being -- willing to come forward but doesn't it really? >> well, he hopes it doesn't but he is concerned as is andrea constand who said the same thing, that this sort of casts a shadow over the whole process and that women might be deterred from coming forward because they don't think the system is there to support them but what i would point out, while this has been described as a technical issue, procedural issue and may be the case it is very much about a constitutional right that we are assured we don't have to self-incriminate ourselv
