we expect a vote in the house this week. nancy pelosi speaking right now before the white house. she is expected to bring that larger bill to the floor this week assuming the congressional budget office comes back with an estimate that shows this bill is essentially fully paid for, which is what the moderates like sinema and manchin have called for and the house moderates have called for. expect that bill if it comes this week to pass narrowly, if the numbers come back, and then the focus will be on those moderates like sinema and manchin. sinema is expected according to her democratic colleagues to vote for the package. where will someone like joe manchin come down. he did not answer when i asked if this should be delayed until next year, only saying they should continue to discuss this amid his concerns about inflation, so while they're getting this big victory here, still big questions about the timing, the substance, and ultimately how that larger bill will come out. more negotiations to come, and joe biden's party fall in line, that's the big question going forward. >> we he

is this a messaging problem for the white house? >> yes, it is. even more worrisome, 70% of ind pen kedents, 70% of independent say he's done little or nothing. it goes to this issue set where they're trying to work on build back better, this massive reconciliation bill and the public generally sort of approves of a lot of the different proposals individually but in terms of the entire massive package, $2 trillion or so, the public isn't really paying attention to that because they're worried about inflation. they see it. a few months ago it was inflation stories about rental cars. now it is transitory. it has transitioned inflation into baking, a loaf of bread, milk, real life -- and gas prices pushing up near $4. so that's where the public is and so the public isn't really focused on their agenda right now, and that's where you see the poll results suggesting he's done little or nothing. >> and it's having a horrible effect on his approval rating. this new poll that says approval rating is 41%. his approval's 53%. this is the strong point coming

jasmine wright is live for us at the white house. the president held a strategy session with his cabinet. how is he planning to fix this? >> that's right, fred. inflation concerns continue to dog this white house into the weekend as americans are paying more for everyday goods and frankly they're not happy about it, and that unhappiness led to a messaging shift from the white house, instead of using terms like transitory or temporary they first used a few months ago, you are hearing everyone from the president to vice president to officials publicly and privately saying this is a big deal and that it is a top priority for the administration. no matter those messaging shifts or measures put in place to try to break apart the log jam of the supply chain, really officials have been starting to say look, it may extend, inflation prices may extend well into the next year, no doubt adding pressure to families as we head into the holidays when they continue to grocery shop, fill gas tanks and start present buying process. friday as you said

is it the current occupant of the white house or the former? >> this is a key ruling we're waiting for now, laura, after the hearing and the arguments because if the d.c. appeals court says trump has no privilege or certainly has no blanket privilege, he might argument about this document or that document, then what right does any other witness have to say a then i have a privilege? >> absolutely. she's exactly right, the judge, to talk about the idea what it actually comes down to. remember, the executive privilege is not belonging to the incumbent. it's the person in the presidency. the former president can no longer veto, no longer the commander in team and their powers are limited even with regards to privilege asergsz so this judge on the three-judge panel know exactly the issue here. remember, there are going to be instances, john, where the assertion of the privilege might be more valid than others, but a blanket assertion that says you can't have any document even when there's an exception here which is valid, a potential criminal act,

they have to turn over the records from the white house. tomorrow the appeals court will hear the former president's case. so what do you expect there? >> yeah. so this is a key step in this collection of information that the january 6th committee is hoping to do. they're looking for hundreds, maybe thousands of pieces of documents from the trump white house in and around january 6th. and this is an appeal of a lower court ruling in which the court said that the national archives can hand that information over to the select committee. but trump and his legal team immediately appealed that decision. this will be a three-judge panel that will hear this case. two of these judges are obama appointees. the other one is a biden appointee, so it's not a very good draw in terms of the former president and his hopes. and one of these judges actually already ruled in a case relating to executive privilege in don mcgahn and wrote a very harsh opinion as it relates to executive privilege and what the trump white house believed it had at that time. and

let's go to cnn chief white house correspondent kaitlan collins. it is shaping up potentially to be very good day for the biden administration. not just a jobs figures, but possibly, right, finally moving on infrastructure and build back better. >> yeah. if the president gets both of those, this is going to be one of the most significant days of his presidency. it would not just be that bipartisan legislative victory he likely gets if they do pass this infrastructure bill as the house says they are set to do so right now. also in addition with this jobs report. and we know we are going to hear from president biden here in the next hour on the jobs report numbers. he's already scheduled to give those remarks and this is going to be something where the white house is looking forward to these remarks compared to in the past where they tried to spin them, it has been months where it is undercut the assessment. this is good news for the white house. if they get both of these today. importantly, it comes in the context of several weeks that have not been

he was no longer a paid adviser to the white house. now, the former president, his legal team, are saying what they say is that it doesn't matter, that the president, former president, can make anyone his adviser, it doesn't have to be someone inside the government. i think that is one of the things that the lawyers in this building and other at the u.s. attorney's office down the street are looking at. trying to figure out, you know, if they are going to enforce the subpoena, that this referral from the committee, whether this is something that can stand up in court. i think that there is a lot of frustration, you can see it on twitter and some of the criticism that you hear of the attorney general and justice department, you can see that there is a lot of criticism from democrats about why it is taking so long. but, you know, people here tell me that part of the issue is that they want to make sure that when they bring this, if they bring this, that it is something that will stand the test of time. they know that it will be dissected

cnn's arlette saenz joins us from the white house. what is the white house saying? >> reporter: the white house is confident that ultimately the vaccine rule for the larger employers will hold up in court. they are certainly preparing for possibly a long legal battle ahead. now this ruling from the fifth circuit court appeals does not appear to have any immediate impact. this rule is not set to go into effect until january 4th, though there are some other elements of the rule that will go into effect earlier, december 5th is when the larger companies will be required to provide paid time off in order for their employees to receive vaccinations and also require masks in the workplace for unvaccinated workers. the top legal officer at downof labor said yesterday that they believe that they have the emergency authority to institute such a vaccine requirement for these businesses, and the white house chief of staff ron klain this morning expressed confidence that it will hold up in court. take a listen. >> i'm quite confident that when this finally gets fully adjudicate

we begin with cnn's phil mattingly at the white house. the president said shut downs are off the table for now? >> for now. shut downs off the table. instead, the white house is focused on vaccinations and boosters. that will be the core along with testing. the president is supposed to lay out a plan about fighting the pandemic as the country moves into the winter months, and obviously that plan royaled by the discovery of this new variant. it's a variant that has caused serious concern inside the white house, and the president during the course of the day, remarks earlier and a moment ago, meeting executives on the supply chain saying this is about speed and science, not chaos and confusion, and that is the core of how the white house is trying to fight and address this new variant. when it comes to boosters and vaccinations, that is the primary focus of what white house officials are pressing on at this moment. they believe this moment in time that boosters will provide at least some protection to what they're seeing from this new varia

, senate, and white house. there were some differences at the end and we'll deal with those as we go forward. what will happen is the -- we have different committee system in the house than they do in the senate, so this bill will now be reshaped to their committees. and at that point, we'll see where we need to, shall we say, reconcile our differences. but at the end of the day, we will have a great bill. mr. pallone? >> yeah. i mean, look, the fact of the matter is that over the last few months, and particularly in the last few weeks, we have been working with the senators not only manchin and sinema but also with the chairs of the committees in the senate. so, you know, i'll use two examples. one is on the drug pricing, right. i mean, we've been basically drilling down and getting sinema's input, getting schumer's input, and so i do believe that the drug pricing provision that you see is it. i mean, i don't know. i guess there could be some changes, but i don't think they're significant. and the fact that we

trump and also the former white house ethics czar. good you have to here. circling back to the documents and the hearing under way right now involving former president trump trying to shield certain documents from the january 6th committee, how do you read the judge's comments? she seemed to have criticism for both sides here. ana, thanks for having me back. thought she was far more skeptical and critical of president trump's claims of executive privilege. she did have some tough questions for the house of representatives but they had good answers, ana. on the -- on the challenge to president trump she made the point, look, you're no longer, sprump no longer the president. the current president says these documents should be released, isn't that it the end of the yaert. that's correct as a matter of law. that's the basis of her decision. she said she would be expedition and she brushed aside claims that there was kind of an injury that would justify the preliminary relief that the president wants. on the side of the house of represent

kaitlan, first, the decision to enact this in january, is the white house explaining why? >> reporter: basically there is a timeline that happened here. we know it was back in september that president biden announced this. this is part of that rule when he had essentially been against vaccine mandates but changed his mind given the level of resistance from so many tens of millions of americans who did not want to get vaccinated. and of course the concerns happening in september with the delta variant led to this. what you have seen behind the scenes since then is the labor department getting red ady to craft this rule and have rules for businesses to go to. now there are 104 employees that by the january 4 deadline will need to be vaccinated or undergo weekly testing. the company will not be on the hook to pay for that testing. the labor department said that is something each of these businesses will have to work out on their own, but that is a january 4 deadline. we will see a deadline go into effect before then, and that's in early december when those unvaccinated employ

what was happening inside the white house on friday? >> over the last couple days the president was working the phones more than he has up to date wednesday, thursday, friday when he got back to the country from his trip abroad. he was talking to progressives, he was talking to moderates. he called into a meeting of progressives. he was basically saying now is the time to do it. he's gone up to the hill but he never said vote today. he finally said that friday. it took until almost midnight till end of the day on friday, more than the 11th hour. but the question is what permanent damage has been done? his approval rating is done now. had this happened in august, i think they would have gotten more republican votes. and, b, his approval rating likely would not be in the place that it is. but it is what it is, and he had a bounce in his step yesterday morning at the white house when he said, me. he has some confidence that he can get this done. fundamentally he believes that joe manchin is not going to block his agenda. yes, we're going t

what is the white house saying? i know the president has been tested almost on a daily basis to make sure he's not positive. >> the president was just tested yesterday to enter the united kingdom, that's a requirement even for the president of the united states to get a coronavirus test. he has gotten his booster shot so doesn't seem to be a big concern for the white house but we learned late last night jen psaki, the press secretary who did not come on this trip, the day before she said she was not coming on the trip and they sent her deputy in her place remained home because members of her household tested positive for krch and she took a test every day and yesterday tested positive for coronavirus. she was revealing it out of an abundance of transparency but not been around senior white house staff since wednesday, not seen the president in person since last tuesday. when they did they were outside and wearing a mask. we heard from several physicians who said it's unlikely she could have infected president biden.

that's something the white house wanted. >> it is something the white house wanted. and it would be a very, very good result for the white house to pull this off because impressions have been this was falling apart and it would be very helpful to the president if he could get this infrastructure bill done and if he can win virginia tonight. you put those two things together and he's -- the presidency gets more back on track. but i don't think it's an international matter that glasgow turned out to be a success. this was going to be the biggest environmental gathering in years. every environmental activist was looking forward to great results coming out of this. if you are an environmental activist you can't help but think this was a severe disappointment of the top six nations, the top six emitters of carbon, only one, the united states, under joe biden, has actually stepped up and been hard nosed about this. the other five nations in the top six, they disappeared on this. they didn't come or they lowered the bar as india did. putin doesn't come from russia. very imp

the real rule the white house has had -- role the white house has had is through their counsel's office and as it relates to executive privilege. the president and his lawyers have made clear they're waiving executive privilege as it pertains to the specific issues that the january 6th committee is investigating related to the attack on the capitol and the lead up to that. it's not just speak to steve bannon, it's other officials, as well, including former chief of staff mark meadows. as it pertains to bannon, the counsel's office was clear the fact that bannon had no role in the white house at the time that this transpired, the idea that he would have any privileged claims weren't in existence based on what the counsel's office said. steve bannon in "peril" by bob woodward and robert costa said he wanted to strangle the biden presidency in his crib. at this point in time he will now have to face the justice department at some point in the weeks and months ahead. >> so what lies ahead for bannon after he turns himself in on monday? earlier, one legal expert explained the process step by

bannon was out of the white house in 2017. i will be candid that mark meadows has a better case with both. the other person you identified there, jeffery clark came in and provided about an hour of answers but still complied with the subpoena. it will be very hard the law requires you to respond. meadows is a different case. the former president will have a stronger presidential claim. you need to come in and on the account of that fact. in open defiance of the subpoena for the call to have to make. >> democrats would be vocal in wanting to be proactive and make these subpoenas to carry weight. the sources didn't think that this was such a simple choice. what does the whole process tell you about garland and the way he's been running the justice department. that ought to carry weight and to step in to enforce them. it is just not going to be efficient to charge every single individual who violates a subpoena. in the jeffery clark example, sometimes people don't come in and answer a lot. sometimes they come in and give some doc
