danny solace is an nbc legal analyst. and malcolm nance is in and miss nbc terrorist analyst. danny, clearly we have two very different cases here. the case of the man accused of killing ahmaud arbery. the case involving call rittenhouse. different sets of facts. was the biggest difference to you when people start thinking about the rittenhouse verdict as we prepare for a verdict in the trial of ahmaud arbery's accused killers? accused ki>> no two criminal cae exactly like, just as you pointed out. in fact, these two cases are very different. in that case of arbery's killers, you have a situation where there's plenty of evidence that the defendants took themselves to the encounter and not only at the very last second they claim self-defense when arbery turns toward them. before that he's doing everything he can to run away and. that appears to be from the defendants own testimony. so, that's a very challenging case for these defendants to claim self-defense. but i think while the two cases show us is there is a lot of reach range between self-defense cases. no two are alike. t

back with us, nbc's cal perry who was outside the courthouse and nbc news legal analyst danny cevallos is back with me. cal, that's the first time we've heard from the jury this morning, correct? >> reporter: yes, first time we've heard from them at all since they started deliberating. this was their first question, and it was to see the video that we saw filmed by william roddie bryan. he's the man in the second pickup truck. it was his cell phone video they asked to see the low-res version, then the high-res version three times. the voice you heard on the 911 call is greg mcmichael, the man you saw on your screen most of the time. that phone call was a centerpiece of the prosecution's closing because you hear greg mcmichael dial 911, you hear the operator say "what is your emergency," and he says, "there's a black man running down the street." the prosecution saying that to the jury is really all you need to know about there case. it, again, was a centerpiece of their closing. >> and danny, when they want to look at that video of the shooting again, not once, not twice, but three tim

let's go now to nbc's julie tsirkin from capitol hill. what kind of warning does this send to others? >> reporter: the committee hopes this will send a serious warning to other witnesses subpoenaed. steve bannon yesterday was indicted on two counts related to his defiance of the congressional subpoena, one, for not appearing for his deposition and the other for not producing those documents that were requested. each of those, by the way, carry up to a year behind bars and up to $100,000 in fines. let's turn now, though, to mark meadows. this is the next target of the committee who hasn't been cooperating with the panel whatsoever. he failed to produce documents this week and also didn't show up for a scheduled deposition yesterday as you mentioned. he was the former president's chief of staff, of course, and was there in the white house on january 6th, so the committee has a big reason that they want to hear from him. now, members on the panel spoke out yesterday after bannon's indictment came through. take a listen to what adam kinzinger

it was from nbc. some other experts talking about the case, right, and why it seems as if this case ended the way that it did. and here's the assessment from some experts. while we can celebrate that justice was done here, if there hadn't been a video, these men probably would have gotten away with it. that was a former federal prosecutor, and then criminal defense attorney bernarda said travis mcmichael really didn't come off as credible. he knew ahmaud arbery was not armed, did not threaten him. he knew ahmaud arbery did not have anything in his pants. do you agree with their assessments, especially as we watched that video a little bit earlier as my colleague, cal perry, was speaking? the video that showed, front and center, what happened on that day. >> i do agree with both of them, particularly with bernarda villalona. i think both of those points are very strong. i think that ultimately, what we have to do is realize in these situations where there is a video, when we do have situations that vid

nbc news correspondent rahema ellis is in new jersey. and larry sabato, the director of the university of virginia's center for politics. thank you for being with me. steve, let's start with you. what's the latest from new jersey? >> here we go. all eyes are on the garden state right now. you see phil murphy, the democratic incumbent. he leads here by just under 6,000 votes, 0.2 of 1% over jack ciattarelli, his republican opponent. look, the bad news for murphy is this was a state that obviously joe biden, as you say, won in a landslide. it's a state that republicans really struggled to be competitive in. and nobody thought this race was even going to be place. i think the suspense both democrats and republicans talking to in the last week felt, hey, is this maybe going to be a single-digit race? well, it's a lot more than a single-digit race. that's the bad news for murphy. the good news for murphy the vote, it seems to be coming in. the remaining vote that's out there, we're still seeing big batches or significant batches specifically

joining me now, nbc news white house correspondent monica alba. monica, we haven't heard much in terms of an official response to this bad night for democrats. what's happening there today? >> reporter: it's possible, joe, we'll get our first response from president biden himself in about an hour from now, when he is scheduled to give remarks on that news of covid vaccinations for kids ages 5 to 11. after that he could always take some questions, absolutely. my colleagues in the room are going to try to press him on all this since he did ignore those queries last night, returning at 1:00 a.m. from this european trip where just about 24 hours ago he sounded very optimistic, predicting that democrats were going to be triumphant in virginia. obviously that is not what happened. and so the white house here is grappling behind the scenes to move this into a more action-oriented plan going forward. they're going to insist that voters were unhappy with the inaction and some of the nitpicking over on capitol hill about what should stay and what should be

joining me from outside the courtroom is nbc news correspondent gabe gutierrez, also joining me is nbc news legal analyst maya wily. thank you for being with me. gabe, the judge admonished the prosecutor yesterday. what's everyone watching for today? >> reporter: it was quite a sight. i've seen judges be stern with prosecutors or defense attorneys before. this was in front of all the cameras. out of the view of the jury, the jury was outside the room at the time but he lashed out at prosecutors, one prosecutor over his line of questioning and also a very emotional testimony from kyle rittenhouse. what we're looking at today the defense as you mentioned expected to call several more witnesses, they indicated they had at least three remaining, one use of force expert, also talk about the time line of events and other eyewitness on the ground at the shootings that night and an expert on shell casings to address some things the prosecution brought up during its case. now, again, several more witnesses late yesterday the judge indicated we could expect closing arguments early next week but

nbc has just called the new jersey governor's race for democrat phil murphy. democrat phil murphy has been reelected to a second term in new jersey, defeating his republican challenger, jack children rarely, we will be talking with the steve kornacki, to tell us why took so long to call this race. but it looks like the democratic party did lose the governor's race in virginia, but not the one in new jersey. which breaks pattern. in a way that is favorable for the democrats. and honestly, the headlines today, while i counted, democrats were just destroyed, the democrats weren't panicking. now they sure ought to be. honestly there is one thing that they ought to maybe panic about, which is the polling that they're terrible against. both the polling for a lot of the races have been pretty much off, like it has been for a couple of cycles. if they don't figured out a way to fix, that their campaigns aren't going to be kept -- so they can panic about that pulling. the fact that polling is bad. yes. okay. but honestly, would have been here for the past 30 years, eve

nbc's antonia hilton and nbc medical contributor dr. natalie azar is joining us. while we're waiting to see how bad this new variant can can be, the country and dr. hotez pointed this out, is still dealing with close to 90,000 new cases a day from the delta variant, this winter surge could be coming. tell us what you're seeing where you are. >> well, chris, here in the boston area, they've been dealing with a spike in covid cases here now for a couple weeks, and just on the friday after thanksgiving, massachusetts reported over 5,000 new cases, and mass general hospital behind me here, they're treating about 40 people with covid right now, and the system here is really strained. there's a pull on resources here. that's related to the continued covid cases and hospitalizations, but also really about covid-related impacts to the entire system here. what we're hearing from physicians and doctors that there's an immense amount of burnout among staff members in hospitals like this one. there's low staffing and some really critical departments, so this new variant is em

nbc's scott cohn for us. it's great to see you. tell us what california is doing. >> reporter: it's a big change in messaging in just the last few day. as we were going through this and the boosters were starting to come online and we got the initial guidance from the feds, the idea was that a booster might be a good thing to do. well, now they're saying, first of all, to providers if anybody comes in asking for a booster whether they meet the guidelines or not go ahead and give it to them. and they're telling the public you really should go ahead and get that booster shot, that it's every bit as important as your original vaccination. and as you can see at this vaccination site in santa clara county, in san jose, they are seeing some steady traffic. a lot of this is families with young children who are now eligible for shots but also people coming in to get their boosters or to get their initial vaccinations. and here's what they're up against even in california which has posted some of the best covid numbers in the nation over th

so, joining me now, from state college, p.a., is nbc's gary grumbach. i understand you're at a testing site, so who's showing up there and how concerned are residents as they're coming off of holidays with friends and family and travel? >> reporter: hey there, alex. there's a lot of conversation in the early parts of the pandemic about the idea of getting the resources out to the community where it's needed. this is a perfect example of that. this is a covid testing center inside what was actually a former sears automotive center just down the road from penn state university, and there's a lot of conversations happening, you know, it's a walk-up site so people have been coming in. it's a steady stream of people throughout the day, and people have been saying, they're getting tested because they were a close contact of somebody who was tested positive. and there are a lot of positive people here in pennsylvania. as you mentioned, more than 6,000 people are testing positive for coronavirus every single day. that's more than 60% from what it was just two w

nbc's ellison barber is in kenosha, wisconsin for us this morning. good morning. >> good morning to both of you. it's a busy day here. court is in recess but as you said there are some 500 members of the national guard on stand by should local authorities in kenosha ask for assistance once the jury finishes deliberations. now we expect the jury will consider some lesser charges. the judge saying he will make that final decision sometime today. rittenhouse faces five felony charges, three of those related to homicide, plus a misdemeanor weapons charge. he has pled not guilty to all of those. if allowed, the jury could end up considering on some of those charges in some of those instances reckless instead of intentional homicide, for example, but there are a bunch of different possibilities that they discussed in court yesterday and, again, the judge says ultimately he will make that final decision sometime today. here's more. >> by having a lesser included offense included, you're raising the risk of conviction, although you're avoiding the possibilit

joining us now, nbc news correspondent ken dilanian at the federal court, nbc justice correspondent pete williams, "new york times" chief white house correspondent, peter baker and melissa murray. what do we expect when bannon appears today? >> hey, andrea, excuse me, we e believe he may already be inside that courthouse behind us, and this is going to be an arraignment, so the charges in the indictment will be read, and he'll have a chance to enter a plea. he's represented by david schoen who viewers may remember was one of the lawyers for donald trump in the second impeachment trial, and look, this is the beginning of a long legal saga for bannon. this case could take as long as a year. these charges carry a penalty of a minimum of 30 days in jail and a maximum of a year per count along with a fine, but what this means, andrea, is that in all likelihood, unless steve bannon decides to cave and cut a deal, the committee will not have his testimony because the calendars just don't match up here. this criminal trial will take some time and the select committee is trying to put out a repor
