>> geoff, it's unclear. the letter that mcconnell released today saying he's asking for nothing in return other than the fact that they want no part in lifting the debt limit. of course if the republicans do, quote, want to get out of the way, that would take consent of all republicans. but mcconnell is pretty good at keeping his party in line when he needs to but it doesn't seem like that's something he's wanting to do right now to get out of the way on this issue specifically. now, moving forward, this is a staring contest like one we haven't seen in a long time. now, democrats know they can use this process of reconciliation which will take several days, perhaps up to a week, that they know it will be messy, they know it will be complicated. but this is the tool at their disposal and this is the tool that mcconnell is saying that they need to use in order to do it. but there is another complicating factor with this process of reconciliation, and that is instead of just suspending the debt limit as if it d

>> it certainly would have helped, geoff. i think i heard bob redfield, the previous cdc director, say if he had to do it all over again, he would have added a whole diagnostic program to operation warp speed or would have recommended it and it would have made a big difference. so i'm glad this is happening. it's about a year too late, but at least it's finally happening. and even though the number of new cases is going down now, many of us are expecting an acceleration after the thanksgiving holiday. so, for example, if we had this home kit, an antigen based kit that we could get an answer on, if you're bringing relatives over for thanksgiving or getting together for various holiday events, that could be helpful. or for the schools, if we could do regular testing especially if we don't have vaccine mandates, it adds an extra layer of protection. no doubt it will be helpful. >> let's talk more about covid and kids. the covid vaccine in kids. because pfizer's vaccine data in children ages 5 to 11 will be reviewed tomorrow. mod

>> it has a terrible impact, geoff. we already saw in the first five weeks that this ban was in place that many women were seeking care outside the state. there is now a six-week backlog in louisiana, a month-long backlog in oklahoma and new mexico has a backlog as well. and that's with only a small percentage of women being able to travel to those other states to get care. and there are countless others who have not been able to. there was a two-day period where the injunction was in place, and many of our clinics reopened and provided that care, even though they knew they were doing it at risk. this law has a retroactive provision in it which provides the ability for individuals to sue even during the injunction period, when an injunction is lifted, if the court later on stays that injunction, which is exactly what happened here. and in the long term, depending on what the court decides, we may live with sb 8 for a long time in our state if the fifth circuit and the supreme court continue to refuse to enjoin the law w

. >>> msnbc coverage continues with geoff bennett. >> it is great to be with you, i am geoff bennett and we're bracing for a major escalation this afternoon in the congressional investigation into january 6. it's deadline day for steve bannon to cooperate with the subpoena from the committee. and his attorney has already told the panel he won't testify or hand over any documents. now, if he's a no-show for today's deposition, the committee could move quickly to pursue criminal charges against him. and the chairman of the january 6 panel says they'll do just that. bennie thompson released a statement about 30 minutes ago saying, quote, i've notified the select committee that we will convene for a business meeting tuesday evening to vote on adopting a contempt report. now, bannon says he's refusing because former president trump is trying to assert executive privilege over his conversations and communications with aides. two major problems for bannon on that front. first, he hadn't been a white house employee for years before january 6. and second, president biden has formally rejected

and our coverage continues with geoff bennett right now. >>> it is good to be with you. i'm geoff bennett. and it is a critical day on multiple fronts in the battle over abortion rights. the justice department is against stepping in, urging courts to rein-state the suspension of that texas law that bans nearly all abortions across the state. the appeal is to a lower court, but the message to the supreme court is unmistakable, quote, if texas' scheme is permissible, no constitutional right is safe from state sanctioned sabotage of this kind before in effect, the doj saying to those conservative justices, the way texas found to get around abortion rulings could be used for instance by progressive states to enact bans on gun rights for instance. and as we await that ruling, a abortion returns part of a blockbuster term that could result in a gusting of roe v. wade. and the case is in kentucky. and an appeals court has already ruled had it is unconstitutional. both of these cases could provide tea leaves on how the court will ultimately rule on what has been the law of the l
