they will continue to cooperate with authorities in hutchins' death. meantime attention is turning to dave halls, the director of the film. josh campbell reports. >> reporter: we are learning new details about the person who handed alec baldwin the prop gun on the day of the fatal shooting here in santa fe. assistant director dave halls who was on set that day had been involved in another incident two years ago involving the accidental discharge of a weapon on a set that resulted in an employee recoiling from that weapon unexpectedly taken off. the person was taken away by a medic but brought back. halls was discharged and ultimately dismissed. we reached out to halls for comment, but have not received a response. we are learning new details surrounding the fatal shooting itself here in santa fe. according to a search warrant affidavit from the sheriff's department, we are told alec baldwin is practicing a cross draw rehearsal where a person pulls a weapon across their body when the fatal shot rings out. the question remains what was inside the weapon.

executive privilege from trump slow or stop the panel from being able to ask questions and compel coope cooperation? what realistically could the committee do if this does get tied up in court? >> well, if it -- first of all, we've gone through this drill recently with don mcgann when he was white house counsel. he decided to litigate it. he successfully lit at this gated it and only because he agreed to settle and compromise did they get him before the house judiciary committee, but that left the law in a mess. the court of appeals, their three-judge panel, says the house has no statute to base a civil action on to enforce a subpoena, unlike the senate which does have such a law. the house has done nothing about correcting that. the house does have inherent powers. again, they've done nothing to exercise those inherent powers. there's a resolution that was introduced by ted lu, congressman from california in the last congress which could fix that where the house could, indeed, hold somebody in contempt and then fine them as long as they remained in contempt and it could get quite expensive for som

we've seen that bannon has refused to cooperate before with the trump/russia investigation. he benefits from this, because he can then promote this idea that there's this deep state that's out to get him. and the punishment for being in contempt is 12 months in prison, which is a lot, and he feels like this is something that only he can chance. and he can hide behind this vague idea that he has executive privilege under donald trump, when that's actually not even true. because trump is not the current president. but as you mentioned, bannon uses this on his radio show to convince his supporters and listeners that the state is out to get you, that they're out to get innocent people. so this works in his favor. and we see that trump's approval rate among republicans never wavered. it didn't matter what he did. it was always around 87, 88%. and the same is true of people that work in his orbit that agree to spew these same type of election lies, about the election being fraudulent, and about the capitol riots. >> i don't have a lot of time left, linda, but we alluded to it, the
