steve, that gun baldwin used was referred to a prop gun. is there any reason why a live round might have been inside the gun's chamber? if not, are there any firewalls in place on the film set to ensure that doesn't happen? >> well, there's no reason to have had a firearm that was capable of discharging live ammo on the set. anything that an actor touches is a prop. so if an actor touches their cellphone, you know, it becomes a prop. but when we say prop gun it means that as a gun that's beenmicically modified so you cannot put live ammo into it. only blanks can pit into it. >> okay, we're having some issues, steve. go again, sorry. we were having some issues. it was hard to hear you and you were pixilated. go again. >> okay. so i was just saying that a prop gun is a gun that's been specifically manufactured for shooting blanks, not bullets. in fact, the bullets won't fit into a gun that's been modified properly, only blanks will fit into it. and that's a safeguard to ensure that live ammo is not loaded into guns that are used on set. so if

this was a real gun that alec baldwin used, not a prop gun, not a toy. it's capable of shooting real weapons as we see with this horrible fatality, and then when you hear that the gun was not under lock and key as it should have been, when you hear there were live rounds on a set, which there never should have been, these weapons should have been under lock and key and under the sole custody of the armor or the property master, and they need to be checked each time they come out and each time they're handed to an actor, each time they're put on the table. you never hand a weapon to anyone without showing it to them, without checking to make sure it is safe. and so in that sense, it doesn't surprise me that potentially the assistant director or potentially the armorer or possibly even alec baldwin in his role as an executive producer could potentially face criminal charges. that doesn't mean you'll see that, but it means it's a possibility. >> certainly is. and as you know, these court documents obtained by cnn show the ammunition was found on the set, so

we begin this hour with new details emerging in the deadly shooting on the set of alec baldwin's film "rust." cnn is warning about past allegations involving the movie's assistant director david halls. two people who worked closely with him tells cnn that he was accused of several safety complaints on two productions back in 2019. also today, new photos just in to cnn showing baldwin meeting with helena hutchins husband and son in new mexico. in a statement the actor said his heart was broken for them and he's fully cooperating as police investigate. helena hutchins died there from the gunshot wound there on the set. cnn correspondent lucy kafanov is in santa fe, new mexico. lucy, what more are you learning about the safety issues and accusations? >> reporter: that's right, fred. we remember from the affidavit, the police affidavit, that david halls was listed as the assistant director who picked up one of the three prop weapons left outside of the structure where the team was filming that fateful thursday by the head arm oher. he picked up the gun. he walked it into the building. he

baldwin fired. >> investigators combing the scene, they collected the shell casings in the case. josh campbell is in santa fe for us. >> reporter: christine, we are learning new details about the circumstances surrounding that fatal shooting of cinematographer halyna hutchins here in santa fe. the sheriff announcing on wednesday it was a suspected live round of ammunition fired from a gun by actor alec baldwin that ultimately took her life. now, there are many questions that still remain. i asked the sheriff how is it possible that a live round of ammunition made its way onto a film set. he said that that very much remains under investigation at this hour. now, authorities also seized several items, including three firearms, over 500 rounds of ammunition. we are told that that ammo has been sent to the fbi's laboratory in quantico, virginia, to try to determine how much of that ammo is the normal type that you would see on a set, the dummy rounds, and how much of it might be live ammunition. i also sat down wednesday with the district attorney. she said that she was shocked to le

baldwin which should have indicated it was safe to use. in the newly released search warrant i should say the deputy on the scene describes conversations with halls and gutierrez. these are not exact transcripts. these are the conversations ass deputy remembers them but in his interview with halls, i'm going to read you a portion, it says during an interview with david halls when the detective asked david about the safety protocol on set in regards to firearms, he advised i check the barrel for obstructions. most of the time there's no live fire, and she, referring to hannah gutierrez opens the hatch and spins the drum, and i say cold gun on set. now, david advised when hannah showed him the firearm before continuing rehearsal, he could only remember seeing three rounds. he advised that he should have checked all of them, but didn't, and could not recall if she spun the drum. the detective also spoke to hannah gutierrez. she told him, according to the a affidavit that on the day of the incident she checked for quote dummies, blank bullets
