alec baldwin -- how does alec baldwin. he was handed what was called a cold gun. and he was rehearsing a scene. isn't this really about the guy who said it was a cold gun when, obviously, they didn't check or know what they were checking for? and the armorer who may have had live ammo on the set? >> not necessarily. when i was in the marine corps, i was taught when handling a weapon. if you need to point it at someone, you need to intend to kill them. if someone hands you a weapon and tell you that it's cold, is trust by verify. you need to verify that gun is safe. if you look at basic gun safety, you treat a gun as if it's loaded. you never point it at someone and you don't put your finger on the trigger unless you intend to pull it. right here, we know alec baldwin, from what we know, didn't verify there was no rounds. why were there rounds in there? it's simple to open the gun up. you can see it. there never should have been rounds in there. for this -- trying to figure out what the line of sight is going to be, et cetera. he has the duty and responsibility. it

this was a real gun that alec baldwin used, not a prop gun, not a toy. it's capable of shooting real weapons as we see with this horrible fatality, and then when you hear that the gun was not under lock and key as it should have been, when you hear there were live rounds on a set, which there never should have been, these weapons should have been under lock and key and under the sole custody of the armor or the property master, and they need to be checked each time they come out and each time they're handed to an actor, each time they're put on the table. you never hand a weapon to anyone without showing it to them, without checking to make sure it is safe. and so in that sense, it doesn't surprise me that potentially the assistant director or potentially the armorer or possibly even alec baldwin in his role as an executive producer could potentially face criminal charges. that doesn't mean you'll see that, but it means it's a possibility. >> certainly is. and as you know, these court documents obtained by cnn show the ammunition was found on the set, so

we saw alec baldwin do that. we've seen statements by the production company. but in this -- in their search warrant, what we saw there from the assistant director, yes, this is the first time we've heard someone say, i did this. i did not check. we should have checked and i don't know what happened. so, yes, like joey said, that's a stunning admission. also hearing from the armorer, hannah gutierrez reed saying we don't keep live ammunition on set and the authorities seizing two boxes of ammunition, 500 rounds, in which they believe there's live ammunition there. that's a huge contradiction. when i heard that, i said, why would anyone even say that? it's wild. >> yeah, i think you're right. where is this heading, joey? >> i think it heads to a further investigation. i think the sheriff will evaluate whether or not with the district attorney it rises to the level of a crime. and if it does, that's what we'll see. obviously we'll see internal protocols evaluated on this particular set which it's on pause indefinitely. i think the movie industry itself will look

steve, that gun baldwin used was referred to a prop gun. is there any reason why a live round might have been inside the gun's chamber? if not, are there any firewalls in place on the film set to ensure that doesn't happen? >> well, there's no reason to have had a firearm that was capable of discharging live ammo on the set. anything that an actor touches is a prop. so if an actor touches their cellphone, you know, it becomes a prop. but when we say prop gun it means that as a gun that's beenmicically modified so you cannot put live ammo into it. only blanks can pit into it. >> okay, we're having some issues, steve. go again, sorry. we were having some issues. it was hard to hear you and you were pixilated. go again. >> okay. so i was just saying that a prop gun is a gun that's been specifically manufactured for shooting blanks, not bullets. in fact, the bullets won't fit into a gun that's been modified properly, only blanks will fit into it. and that's a safeguard to ensure that live ammo is not loaded into guns that are used on set. so if

alec baldwin is also a producer, not the only producer on the show. what liability could he be looking at if any here? >> yeah, don, my view right now is alec baldwin in his capacity as an actor does not have any liability. i think the standard norm we've heard from various experts is if you're an actor and handed a gun and told cold gun, you're entitled to bank on that. as a producer, what role did he do? not all producers are created eq equal. if he was directly involved in the hiring of people that may have had red flags and management of that site, he could have liability. it's more likely going to be civil liability for someone in that position but very serious issues here. >> prosecutors and police have already gotten a search warrant executed by the sheriff. does that tell you anything or is that just standard operating procedure, pro forma? >> that does tell me something. to get a search warrant you can't get that on a whim. you have to as a prosecutor and police officer write out probable cause. you have to write an affidavit and bring it to

that should have been probably what alec baldwin was drilling with. apparently he was practicing a complicated cross draw maneuver, which is not common, where the holster would be on the opposite side and you draw across your body. that should have been probably what he was practicing with. it's interesting that there were 500 rounds removed from the set, whether they were live ammo, blanks or dummy rounds. what a dummy round is, it's basically an inert round. there's no gun bo prouder. sometimes they're filled with bbs so you can share them and hear what they sound like. i'm curious to find the breakdown of how much of each type of round was available on that set. >> scott, you point out the number there of rounds, this is a western. 500 rounds. is that an atypical amount regardless of the breakdown? >> i've been on sets where you can pop 100 rounds in a day. it's not that difficult to do. so if they were -- if this was for the whole production, it's possible. i don't know what the script is like or how much gunfire there was. that is not uncharacter
