that's what they will be looking at for baldwin. for halls who passed the gun for him, different standard there. he was on the firearms safety end of things. and it was his job to make sure baldwin was getting a gun with no live ammo. and the armorer becomes the other potential target in the case. the sheriff kept talking about the key to this case is who put live ammunition in the gun? and the armor her, she's the person in charge of checking the guns every day, securing the guns, as joey said. and, obviously, that was not done. the standard is did you do something without due carry and sir couple inspection. if you did that, that gets voluntary manslaughter. the question is, will it rise to that level? >> it seems like there are so many layers here where things went wrong. from there being live ammunition on the set to the fact we learned cast members were blinking, they were shooting beer cans, to did the a.d. or the armorer check the gun. does anyone in an oversight role who may be aware there have been problems, what responsibi

you see baldwin here. he was out at the sheriff's office. as you can see, understandably likely shaken after the incident. >> for sure. investigators say halyna hutchins was airlifted from the set of "rust," a western, being filmed near santa fe, pronounced dead at the hospital. the film's director, joel souza, also injured. stephanie elam joins us now. stephanie, the film's producers are saying they're working with police. what more are we learning about the circumstances of this? >> yeah. there's a lot of holes at this point, no doubt about it, jim and erica, when you look at what's happened here. we know that the sheriff's office says they got a 911 call about a shooting on the set at the bonanza creek ranch, this movie set filming this western. they said when they got there, there had been two people shot. we know who they are. we also know that they are talking to all the witnesses, the people who were there on the set, that they are interviewing everyone, that no one has been charged, but the investigation remains open. as far as the c

baldwin which should have indicated it was safe to use. in the newly released search warrant i should say the deputy on the scene describes conversations with halls and gutierrez. these are not exact transcripts. these are the conversations ass deputy remembers them but in his interview with halls, i'm going to read you a portion, it says during an interview with david halls when the detective asked david about the safety protocol on set in regards to firearms, he advised i check the barrel for obstructions. most of the time there's no live fire, and she, referring to hannah gutierrez opens the hatch and spins the drum, and i say cold gun on set. now, david advised when hannah showed him the firearm before continuing rehearsal, he could only remember seeing three rounds. he advised that he should have checked all of them, but didn't, and could not recall if she spun the drum. the detective also spoke to hannah gutierrez. she told him, according to the a affidavit that on the day of the incident she checked for quote dummies, blank bullets

there's a chance that alec baldwin could face liability as a producer on the film. you know, after listening to the d.a. there, what is your sense based on what we know? do you see criminal charges potentially coming and if know for whom? >> well, she's absolutely right about two things and this is a tragedy and should not cave to pressure. it must be the actual evidence but saying, that erica, the evidence seems to be pointing towards extraordinary negligence. if it's a criminal peru, you're talking not only about nefarious conduct of someone intentionally or putting the live ammunition and rounds into a gun there are also ways to charge for even accidents, and nobody wants that to come about because, of course, if things are truly accidents as new mexico will tell you, they do have answer accusable homicide statute that says if somebody has been involved in an otherwise lawful activity and they have acted reasonably, they should not be convicted of a crime. however, that word reasonably, erica, is why this is such an important case to look at, because when it come
