alec baldwin is also a producer, not the only producer on the show. what liability could he be looking at if any here? >> yeah, don, my view right now is alec baldwin in his capacity as an actor does not have any liability. i think the standard norm we've heard from various experts is if you're an actor and handed a gun and told cold gun, you're entitled to bank on that. as a producer, what role did he do? not all producers are created eq equal. if he was directly involved in the hiring of people that may have had red flags and management of that site, he could have liability. it's more likely going to be civil liability for someone in that position but very serious issues here. >> prosecutors and police have already gotten a search warrant executed by the sheriff. does that tell you anything or is that just standard operating procedure, pro forma? >> that does tell me something. to get a search warrant you can't get that on a whim. you have to as a prosecutor and police officer write out probable cause. you have to write an affidavit and bring it to

so the questions for us going into this, alec baldwin is preparing for a scene. he's with his director of photography. and his director. he fires this weapon that is handed to him. in the narrative from the officer here known as the affiant, the person who puts together the affidavit of what happened, asking for the search warrant, alec baldwin is told it is a cold gun. what's a cold gun? a prop gun that didn't have a live round. now, again, do they put real ammunition in weapons on movie sets? it's hard to believe that that could ever be yes as an answer, right? they don't want to really shoot anybody. so then what kinds of rounds or ammunition or charges or casings are put in these prop guns that could be dangerous? none? some? what are the circumstances? what did they use here? we're going to have to find all that out. and we will get some of the answers in just a moment. but in terms of why we're doing this, alec baldwin is one of the best known actors in the world. he fired this weapon on set, rehearsing a scene. and now his director of photography, who was

this was a real gun that alec baldwin used, not a prop gun, not a toy. it's capable of shooting real weapons as we see with this horrible fatality, and then when you hear that the gun was not under lock and key as it should have been, when you hear there were live rounds on a set, which there never should have been, these weapons should have been under lock and key and under the sole custody of the armor or the property master, and they need to be checked each time they come out and each time they're handed to an actor, each time they're put on the table. you never hand a weapon to anyone without showing it to them, without checking to make sure it is safe. and so in that sense, it doesn't surprise me that potentially the assistant director or potentially the armorer or possibly even alec baldwin in his role as an executive producer could potentially face criminal charges. that doesn't mean you'll see that, but it means it's a possibility. >> certainly is. and as you know, these court documents obtained by cnn show the ammunition was found on the set, so
