joyce, always a pleasure. let's get into this here because we have several major doj headlines to talk about. let's start with the doj saying that the irs has to turn over trump's tax returns to a house committee. what is the legal significance of this? >> well, the legal significance of this is that congress's balance of power with the executive branch is being properly maintained. the statute that this happens under actually requires that the treasury department shall provide this sort of material to congress upon a request. there's a very low threshold here perhaps for treasury and the justice department to make sure that this is pursuant to a legitimate congressional inquiry, but congress has more than met this threshold and it is long past time for this sort of action to be taken here. this really restores the balance of power between the branches of government. >> in terms of time, joyce, how long is it going to take for congress to get these documents, and does it mean that they would be released to the

so, joyce, what do you make, first, of the request and what might it mean for matt gaetz? >> this is a standard request that you'll see from the government and a defendant jointly when cooperation is ongoing and it can mean one of two things, chris, it can mean that the cooperation is productive and that they're making cases on other suspects but they need a little bit more time. on other occasions, though, it can mean that while there's a good faith effort to cooperate being made by someone in greenberg's shoes that it hasn't yet been productive. the government is giving the defendant a little bit more time to see if he can do something that will help him get credit for sentencing. we don't know which of those two scenarios is at play here. it seems a little bit more likely since this is characterized as ongoing meetings that investigators and prosecutors simply need more time to debrief greenberg and make sure they get all of the information that he's privy too. this probably means that estimates that gaetz would be indicted in july were a little bit too optimistic and i

joyce beatty got arrested the other day, but the argument is we need a road forward. joe biden is key to that road forward because of the filibuster. >> absolutely. listen, joe biden should not fall into the joe manchin trap of believing that there are ten magical friends of republicans who are going to step forward to provide 60 votes in order to pass some form of voting rights. we know that's not going to happen, so the alternative is what mechanism, what carve out or exception to the filibuster or reform, if he prefers that term, is he going to be able to convey to his friend joe manchin to pass, because without it we're not going to get voting rights. and i think what we've seen in the latest supreme court ruling, from arizona and what we've seen in the audits and what we've seen from the -- i use audits loosely. and seen in the texas legislation making its way down the pike is that we need federal legislation. we're not going to litigate our way out of this. unfortunately we're not going to be able to persuade republicans to defend democracy. so what and how are

and joyce vance, who is a law professor at the university of alabama and an msnbc contributor. mike, the president is going to dial up the rhetoric today. beyond the rhetoric, there's not much that he can do legislatively as long as the filibuster remains and as long as there aren't ten republicans willing to support voting rights legislation. president biden talks all the time about how politics is the art of the possible. but right now, mike, what's possible? >> reporter: well, jeff, i have to say the last time i was in this room covering joe biden, he was a candidate fpresident. it was a little over a year ago. he was celebrating some primary night victories. at the time what the biden campaign thought was their formula for success was separating issues that have a very loud and vocal following among a very narrow slice of the electorate and separating it from the issues of importance to a much wider swath of the electorate. in the case of voting rights, you couldn't have a more white hot issue of importance to both the party's bases at the moment. what the president is tryi

>> well, it is right to what joyce is talking about. when you have somebody under the conservatorship in a law of the state in this case california, it strips every right that person has. the right to enter into a contract and like you would have to do to hire your own lawyer, and sets up a specific process about what happens when a conservator is removed and it puts all of this in the hands of the judge who has to make the decisions based on the evidence before him or her, and in most cases, this is somebody who can't really take care of themselves or is in failing health, but in this case, it is somebody who is clearly a healthy woman, but whose conservatorship began over mental health, and now it is showing how difficult it is to get out of all of this. one of the conservators in this has withdrawn saying that i did not want to act if it is against her wishes. her attorney who is still representing her now, and seeking to withdraw is citing the same thing. and even britney spears' mother has given a statement to the court saying that

. >> joining me now is joyce van, i am going to start with this. on a scale of one through a thousand on the likelihood that i would one day won the championship or the chances of being a millionaire tomorrow , what are the chances that donald trump will sit in a lawsuit against social media companies? >> if one is the lowest then i am going with one, jason. >> and the reason is because and this is my thought as a non-lawyer. one, donald trump does not want to go through with this lawsuit to begin with. it would lead to discovery or all sorts of investigations and e-mails of intimidation attempts between him and members during the campaign. what could he be doing by claiming he wants to sit for a deposition, how is it helping him or any of his lawyers? >> this looks like a fun raising stunt from the moment he filed the lawsuit. he and the republican party sent out fund raising e-mails. it would be surprising to see it goes as far as discovery because of the fallacy of this legal claim that social media platforms are government entities. it boggles

. >> joyce, i don't know what to make of this rise of the moore's group that we saw in massachusetts yesterday, apparently on their way from rhode island to maine, they seem to have affiliation with the sovereign citizens movement with which you have had some dealings? >> it gives us some sense of how broad the american tear landscape is and what an important job the fbi has on top of it. rise of the moors is typically believed to be an offshoot of sovereign citizens. but then one of the men arrested was able to put out a statement saying they weren't. historically rise of the moors has had a unique belief that they are exempt from u.s. law because of the 1787 treaty between morocco and united states. that treaty does not exist. that pretty much exemplifies the belief of the sovereign citizens which are the conspiracy theory of conspiracy theory us. they believe things like at birth everyone is assigned a bank account depending on which sovereign group you listen to and they exert their ability to be independent from government control, they can have that money back. they don't have

attorney for the northern district of alabama, joyce vance. i listened to your podcast episode that just dropped today. i encourage everybody to listen to it because you guys tackle a bunch of issues, including this one, and you say weisselberg isn't looking at a lot of jail time if convicted. as to whether he could flip, you pointed to others who said they wouldn't but did. did you elaborate? >> it's an interesting issue that prosecutors face. what do you do when you're building your way up the chain, you've got someone you need to become a witness, but they're resistant to cooperating with you. so the reality here is that what weisselberg ultimately faces under this indictment if he's convicted is most likely a sentence in low single digits, and he may have decided he certainly would have been well aware of that during negotiations before indictment, so he may have well decided that that's something that he can deal with. but what you're referring to and what i think is really interesting here is the evolution that we saw with michael cohen

joyce, i love the fact they essentially wrote their own indictment with spreadsheets. your thoughts. >> well, this is an absolutely fascinating sort of commentary tour for the top executives at the trump organization to be making right now. of course they haven't been indicted yet. allen weisselberg is the one who's indicted in this particular indictment at least so far. but it's hard to figure that there aren't criminal defense lawyers for any number of people who have been out there just face palming as they hear this sort of commentary. you know, what you expect from the owner of a company when there is an indictment like this is to deny the conduct occurred or express outrage. this sort of approach saying, gee, it's not much of a crime, is it, is really unusual and probably won't play well if it ever has to play in a courtroom. >> it's sort of like i only rob the five and dime argument. it's not like a rob a rich company like walmart. that doesn't help you if you rob the five and dime. this is one of the things that trump argued. never before -- never before -- has
