we saw a law of that nature in arizona passed by republican-controlled legislature, upheld by the supreme court this week. so these are very controversial issues. republicans are trying to make sure that the rules for voting are stricter. democrats are trying to make sure that as many people are able to vote as possible. there are some tensions, of course, between ballot access and ballot security. but as i mentioned in that piece, one of the reasons why the debate is as heated as it is is that in each case, the parties i think perceive themselves to be getting some kind of advantage by having the legal regime surrounding voting that they prefer. republicans believe that if you tighten up some of the protocols that we saw in the 2020 election, that they would win more races, possibly given that the presidential race really came down to fewer than 45,000 votes, remaining battleground states. from an electoral college perspective. the democrats believe that the greater the turnout, the greater their chances of winning. clearly they are pretty happy that joe biden has 81 million votes. that

let's look at what's going on in arizona. a bill just was signed talking about critical race theory. it lets look at what's happening there. arizona governor signed a bill preventing local government -- governments from teaching local -- critical race theory. for him it's the state and any local government from inquiring -- forbids state and any local government from inquiring -- from requiring their employees to engage in orientation, training or therapy that suggests an employee is inherently racist, sexist or oppressive whether consciously or unconsciously. the measure comes as critical race theory becomes the latest flashpoint in the culture wars. the theory which is decades old examines the impact of racism on history and maintains that racism is systemic. republicans have used the term critical race theory as a catchall for teaching racism with some panning the bill as discriminatory. let's go back and talk to darrell who is going to jackson tennessee. garo -- darrell, good morning. caller: good morning. the problem is

democrats challenge two arizona rules. one, that tosses out ballots when voters show up at the wrong pre precinct. the ruling was 6-3. that a reflection of the court's powerful conservative majority and it sends a clear signal this court believes states get wide latitude in the voting rules. we are joined with the big final day decisions. >> very big, indeed. and the take away from this is that this is going to make it a lot harder for challengers of these voting laws to actually prevail here. because in this 6 3 decision written, this didn't just uphold the arizona laws that have been in effect for many years. but this restricted the ability of challengers to really challenge section 2. and the reason why this is so important is that really section 2 is the only way now for these people to challenge these voting laws. that's because in 2013, the supreme court struck down essentially section 5 of the voting rights act. that was a section that mandated that jurisdictions with the history of racial discrimination, they neede

did you see any of bearing on that outside of arizona? >> sure but there are two ways to attack these voting lieus. one is the statute, which is the voting rights act. the second is the constitutional treatment, equal treatment, equal process, not discriminating. if you look at, for example, the justice department's recent lawsuit in georgia it makes both statutory and constitutional claims. there are still parts of section two. of course, a lot of these will be fact-bound questions in these state laws. so, you know, it certainly is not good news for the people who are challenging these statute, but it's not the end of the road. >> natasha, your reaction this morning? >> it's very disturbing, disappointing. the bottom line is we're seeing the voting rights act that was passed because people had to actually force it to get passed in 1965. so the two provisions that give teeth to the voting rights act were section 5 and section 2. section 2 is the premise in which in what we're seeing right now that the doj is going to sue georgia. what is

arizona's is among a whole new sweep of laws that in fact, it's not a matter of discrimination as she is caricaturing it, but they do make it harder for reasons of their lives for minority voters, disproportionately. the big point here, is that section two was available for just this before today. it really has been, got it would be too strong a word, but it no longer is the tool it was. it sort of an explanation point on a term that moved to the law in many directions. one more thing about this case, the argument across the country's republican legislature saying, we have such voter fraud, and we really have to do these laws for that reason. that's proven to be kind of a phantom argument, but the court took it appear. they said that's a very important reason, and we are going to endorse it, and thought of course it is poorly a lot of laws out there. >> shannon: okay, harry mentions the slew of states that are doing this kind of thing, the doj announced last week it's going to sue georgia over its law in reaction to this ruling today said, the department remains strongly committed to
