travel out of richmond across towards center fell about 8 minutes for you. there at a look at the golden gate bridge. 19 minutes as you're traveling. 37 to the tolls will have more traffic coming up. but for now, james, we'll send it over to you. good enough. rain, a thank you much at 5 o'clock. let's get to our top story this morning, california continuing to show some promising signs that the omicron wave is slowing down, has infection rates and hospitalizations are still falling. >> recently, the state saw an average of more than 87,000 cases reported more than 15,000 people in the hospital with positivity rates down slightly from earlier this week dropping to 18.7% right now just over 81% of californians are fully vaccinated as the number of positive cases decreases questions about mandates are increasing. and we're now past the peak of the omicron wave. so the state's mask mandate how much longer will stay in effect? it scheduled to expire on february 15th. the kron four's rob nesbitt has some insights from health officers in marin and alameda counties.

>> omicron spread quickly at first quadrupling in a week in some places. now that we're finally seeing a decline. health experts don't want to slow that process down by easing restrictions. there have been a lot of positive cases last 2 months, but not a lot of positive outlook when it comes to omicron in marin county, the berrien finally started to trend downward after january. 4th. >> but it's not a fast process. according to health officer doctor matt willis, our case rates are going down more slowly than you know, we're now seeing about 200, 50 cases on average per day in marin county. >> and that's been the stable number for the past 3 or 4 days down 40% from the peak of omicron alameda county health officer doctor nicholas moss says omicron also peek at the beginning of the month. he's now paying attention to hospitalizations which tend to lag behind case numbers repeat with our hospitalizations. we are very similar to where we were in it with loss. surge before the first positive

disease in san francisco. i'm rob nesbitt. kron. 4 news. >> well, the california department of public health has confirmed that there are 11 cases of the new omicron subvariant here in the state with at least 2 cases being reported in santa clara county. >> they're dubbing it the stealth omicron health experts don't believe that this new strain is causing any more severe disease than the original. but the world health organization says it's monitoring the situation noting that they are detecting it in some other parts of the world as well. well, new this morning, the city of berkeley has announced new covid vaccine and booster mandates for certain businesses. proffers camila barco joining us live this morning with more on what this will mean for locals. good morning, camilla. >> good morning, james. starting next month, employers that certain businesses in berkeley must be up to date on their vaccinations and the city's health officer is also requiring these businesses to require customers to be fully vaccinated. so starting february 7 customers must show

proof of vaccination. this means that they must be fully vaccinated before stepping inside businesses, nonprofits and other organizations, organizations. and that order applies to anyone who is 5 years or older. so you're good to go. if you are up to date on their vaccinations, including a booster shot, if you are eligible now, if you were recently eligible for the booster shot, you must be fully vaccinated by march 14 or within 60 days of becoming eligible. now that some of those businesses that was talking about include bars, theaters, entertainment venues, gyms, and any other large indoor event, we 500 or more people. the city's health officer says that these are the places where the virus can spread easily. and by staying up to date on the vaccine's, people are less likely to get infected. now, the city of berkeley is also ordering all employees at venues in the city to be up to date on their vaccinations. starting february 7 workers at these places on your screen. let's tap their covid vaccinations

and their booster shot. if they are eligible. so this includes restaurants and other places where there food or drains gyms, indoor events of 500 or more people, adult care facilities, day programs, dental offices, pharmacies home health care, and home health care workers and all childcare facilities, whether they're public or private. and this applies to all employees, contractors and volunteers who work at these ideas. other questions about says if you're you're up to date on her vaccinations. now, europe today in your vaccinations. it's been lesson 5 months since you got your pfizer or moderna shot you or you got your 3rd dose at least 5 months after your second shot. you're also up to get on your vaccinations. it spent less than 2 months since you got your johnson and johnson vaccine or you've got the second dose of any brand, at least 2 months after that gate and j shot. so people in berkeley might want to check

your vaccination card. see if you are up to date on your vaccines. james, to you. alright, camila, thank you very much. >> 5, 0, 6, on the clock. and happening today, we have cvs pharmacies that are inside target stores. they're going to start distributing free n 95 masks to customers. the drug company says that masks are limited to just 3 per person while supplies last all the stores will be posting signs to indicate that the masks are now available. it's all part of the federal retail pharmacy program. all these masks are being provided free of charge by the federal government. the forty-niners are going have another day of practice today as they prepare to face the rams in the nfc championship game on sunday this morning, we have updates from the players ahead of the game and that's what kron four's will tran is following for us live from levi's stadium morning. will. >> good morning, james. here's what you need to know. it looks like the niners should be at full strength. it's a practice to practice yesterday. trent williams, he's probably the mvp of the

team because with no line jimmy g can't throw and they can't run and they are famous for ground and pound and he is arguably their best offensive lineman. he did not practice yesterday. they will need him once they leave levi stadium to go down to southern california where the game is on sunday afternoon where they are very familiar, of course, with the la rams. just looking at some of the odds right now, james, it is fifty-fifty. some people say the when others say the forty-niners will win. well, history is on the forty-niners side. they won for the 6th time in a row. the last time they met. they're hoping for 7 on sunday. we'll just have to wait and see regardless. so there are so many subplots of this game, james, including should the niners lose and we'll just have to wait and see how it plays out. will this be jimmy g's last game in 9 years uniform jimmy g he fully knows what's going on in society and sports culture. here's what he had to say about performing with all eyes on him.

>> 5.15, is the time. let's get you caught up quickly on the latest with the fire burning down santa cruz. you can see here your big sur actually the wildfire now 60% contained. so it's actually gone up from yesterday. so there's an improvement there better than halfway. there. >> still holding the size of 700 acres. so it hasn't grown so good on that front. investigators say this was sparked by a prescribed burn that got out of control. they were trying at the time last friday night, too.

weekend. so from today's crystal clear skies to partly cloudy to mostly cloudy on into friday saturday and sunday. now i had been hoping for a switch up into next week. that would bring us some rainfall. but it looks like all our forecast models are projecting anyways that this high pressure ridge is going to continue to stay in place. keeping us dry and your first week week of february winds, certainly a lot calmer than they have been today, which is a very nice know, as we've already talked about. and today's temperatures also a very nice note climbing well into the 60's at the coastline and for our base shore and inland areas climbing into the mid to upper 60's at times for the south bay, just as warm as it was yesterday. santa clara campbell, san jose and milpitas each at 67 degrees. hayward union city down to fremont in the mid 60's while looking at temperatures in the mid to low 60's across the east bay shoreline into our inland east bay area's the lady own benicia. 62 degrees each well. santa rosa, comfortable 65 today. and tomorrow, definitely the

here in one 60 to conquer to 42 about a 40 minute drive. and as you're traveling southbound 6.80, dublin to fremont the air. it will take you about 13 minutes to make it to 2.62. james, back to you. rain a thank you very much. coming up on 5.18, at 5.19, now. >> governor gavin newsome was at ford's silicon valley innovation center highlighting part of his climate change related budget. now the governor wants the state to spend 10 billion dollars over the next 5 years to invest in electric vehicles. and that includes funds for trucks and buses and charging stations and money to help low-income buyers purchase these cars. the plan is part of the governor's 37 billion dollars. climate change or climate action budget that aims to decrease the state's reliance on oil and gas. >> california is on the tip. of the spear in terms of the effects of climate change in extremes. but we also are on the leading edge of innovation, leading edge of addressing with a resilient

mindset, these anxieties not just for the country, but for the globe. >> well, the event came just hours before the state assembly budget committee began weighing the governor's overall spending plan and its first hearing. but the committee didn't take any action, but will the following the latest from sacramento. now let's go to dc with u.s.. officials saying that russia's latest demands when it comes to that ukraine and nato offered no real change to the current situation. so it's not getting much better. basil, john has been following it all for us from dc joining us now live with the update. good morning, basil. well, james, good morning. and yes, russia demanded a written message from the u.s.. >> and nato and now this latest message from them. both it possibly sets up this possibility of a war breaking out in europe. >> there's no change. there will be no change in a letter to the russian government. the u.s. refuses to give in to moscow's demands. we make

clear that there are core principles that we are committed to uphold and defend secretary of state antony blinken says the u.s. and nato will hold their policies in place and not allow russia to dictate how the situation is handled, including ukraine's sovereignty and territorial integrity and the right of states to choose their own security arrangements and allies. the u.s. has already delivered military assistance to ukraine with ammunition, an anti armor systems. more deliveries are expected in the days to come. blinken echoed the message that any military aggression into ukraine will be met with consequences and economic costs as part of our response. we're also prepared to impose export controls that will have a longer term effect. >> the 9 russia products that it needs to fulfill its key to have visions. >> and white house press secretary jen psaki says russian president vladimir putin needs to think about the consequences his country would face. that includes impacting >> business and economic interests of president putin and the leadership of the russian government.

big story this morning. supreme court justice steven briar is retiring. >> and now president biden will get to make his first supreme court pick since taking office. we know the past. he's pledged to fill that seat by naming the first black woman to the high court kron four's theresa has a look now at the short list of possible nominees. let the speculation race began. president biden now focused on placing his pick on the united states supreme court. >> following justice priors retirement from the bench, joe biden said when he was running for president that he was going to nominate a black woman. he was going to make a historical nomination of a black woman to the supreme court. there has not >> a black woman. there is a woman of color. sonia sotomayor is there and there have been women, but i think is going to stick to that pledge, which narrows the field down to a few people.

already reports of open drug use at that facility. somatic experts are now questioning how the center is supposed to be helping people cropper. second takes a look. >> play supposed to help people with recovery and wrap around services. now at the center of controversy as reports of drug use have surfaced at san francisco's new tenderloin linkage center within just 10 days of opening. the center is part of mayor london breed's tenderloin state of emergency declaration. and when asked about drug use their on wednesday, she didn't deny that it was happening. we can't control. >> who does or does not? you do do or do not use drugs at any given location. our whole point of why we set up this link its center is to meet people where they are and to try and get them the help and the support that they need. however, former addict and now recovery advocate tom wolf says the linkage center is doing the exact opposite in order to get somebody in recovery, you have to help find the right environment for them too. >> except that help. and how

are they going to do that? if the guy sitting next to smoking met? it's really, really hard. and it's already hard enough on the street to do that. why are we making this so hard in the mckay center to wolf walked the facility on tuesday and was disappointed by what he saw that walked over to this area. this outside courtyard that they fenced off. and you can kind of see to the fence and i looked and first thing i saw was 2 guys smoking fennel professor of psychiatry at stanford university. keith humphreys agrees. >> calling the center's mission and actions counter intuitive. what is the plan here? i is if they end up wanting to set up safe supervised drug consumption site, this is not the way to do. he would mix it with the center. we're trying to get people the treatment that should be somewhere else. that should be, you know, through what's going to be the easiest for people to access what is going to make you know, stay on a good path. >> and i just don't just a

disorganization. meanwhile, some addiction experts disagree calling the use of drugs. a reality went on the road to recovery. others have also questioned the legality of the site if illicit drug use is taking place. >> in san francisco, taylor kron. 4 news. >> well, in the south bay, one lawsuit has already been filed against the city of san jose. just one day after city leaders passed a controversial gun control law. the new law requires gun owners to have liability insurance and pay a fee. it's the first gun reform law of its kind to be passed in the u.s. and its aim is to promote safer gun ownership. the mayor says that officers will not take away guns unless there's a reasonable belief that it will be or has been used for violence. but opponents say the law violates their constitutional right to bear arms. >> the city of san jose is forcing citizens exercising a constitutional right to bear arms, particularly in their homes. they're taxing that and giving the tax money to

nonprofits to then use it for speech that we all know is going to be used to criticize that very constitutional right. i'm confident that we're going to emerge from this litigation. >> with an survives constitutional scrutiny and we'll be able to implement this. >> well, more lawsuits are likely to be filed. the ordinance does not specify how much the insurance will cost, but the annual fees collected from the ordinance will be used. they say, by non-profit organizations that are working to reduce gun violence. well, this morning, we're hearing the jewelry store owner who fought back against people who tried to rob his store. the sun update actually to a story we brought you yesterday morning right here on the kron. 4 morning news. this all happened at that and friend mall in san bruno and his security video showing people smashing a jewelry case with a crowbar and then the store's owner runs over. you can see him reaching for his belt. he actually pulls out a gun as you can see there and scares off the mask. man. >> it was a bad everybody is
