the video to police. it was for entertainment purposes. we used to say if you see something, say something. today it's see something, say nothing. this is a reflection of how our society has disintegrated. a culture that has no feeling for the victim of crime. the this could never happen to me attitude is adopted so people could feel they are immune. so they only see it through the lens of entertainment. the rapist had been ordered deported. but an appellate immigration judge protected him in spite of his convictions for drugs and sex abuse. in the end a woman was forced to you suffer because the judge determined the person was

allowed to live in america. lawlessness in this country is worse than ever. what's different, however, is the sense of permission the criminals have. that they are allowed to vent, to steal, to loot. after all, businesses have insurance. so we let them steal with no consequence, no aquest, no convictions, no jail time. we'll let them burn down neighborhoods and businesses because they want social justice. as if the destruction of property and lives brings them anything. it only hurts victims. murder have spiked in major democrat-run cities across this country. for theland. country. las vegas, 71%. children going to buy candy are

sodomize a 9th gait girl in the bathroom. when the father tried to voice his opinion at a school board meeting on allowing transgender students into the student's bathrooms. he was arrested and called a domestic terrorist, then made into a posterboard that provided the radical attorney general garland with the basis he used to deploy national law enforcement, the fbi against parents in the united states of america. let's not forget the border. we don't screen them or vet them. who among them is a criminal? who among them is a gang fleb? who is a pedestrian file? who is a sex offender? who has an alcohol problem, a

6:10 pm
>> that was a hell of an open. i have known you for a long time. you were a kick-ass prosecutor. and we are in trouble. i have been calling it the criminal injustice system. it system is broken and it's the criminals' problem. i testified before congress over 100 times in the last 35 years. i have testified before every state legislature and we have never been in this state. crime rates are worse than they were after the civil war. 338 cops went to work one day this past year and never made it home. men and women. we had a record number of homicides. 22,000 murder. it's the highest number since the fbi started keeping home cried record in 1960. murder are up 30% all over this

judge jeanine: breaking tonight, big questions remain as the investigation continues into the deadly and shocking alex baldwin movie set killing that killed i am maaing to a for halyna hutchins and wounded another. listen to this 911 call. >> we need help immediately. >> was it load with a real bullet? >> i cannot tell you that. we have two injuries from a movie gunshot. jenna: how could this have happened and where does the
6:20 pm
investigation go from here? fox news analyst gregg jarrett joins me to break it down. you and i both know hopefully there was a camera where they were filming what happened here. but let's start with the fact there are two tracks here. a civil liability issue, and criminal liability responsibility. and let's talk about the fact that alex baldwin, the person who shot the gun, he's the executive producer of the company. it goes back to him from ruch rush"rust" production goes backo the company he apparently owns. >> there will certainly be a civil lawsuit alleging wrongful death arising out of negligence. that's an incredibly strong
6:21 pm
case. but you just don't have this kind of a tragedy happening absent some measure of negligence. the real issue is what about criminal culpability. if it's true that alex baldwin had no idea there was a live round bullet in the gun, then he would not be charged with murder. but there are other potential lesser charges. for example, in new mexico where this occurred. involuntary manslaughter which is grossly negligent or reckless conduct resulting in death. the failure to exercise due care and recklessly fail to protect the health and safety of your co-workers. as executive producer, he's potentially culpable in that regard. in the final analysis it's up to
6:22 pm
him to make sure everybody on that set including the licenses armorer is competent, sufficiently trained and doing the job properly. judge jeanine: the armorer is 24 years old. the daughter of a very famous hollywood armorer which brings questions up as to how she got the job, she just finished one job. she complained on a podcast that she wasn't sure she was up to it. and she -- think think think like the prosecutor. she actually took the cartridge out of the gun before she gave it to the sheriff. that has been reported. >> all of that is very suspicious. it's what law enforcement is investigating. they are obtaining affidavits and eyewitness testimony.
6:23 pm
they are look for videotape or film of the incidents. someone who is a neophyte on the set in charge of a gun, if it's true that this was a live bullet round and she mistakenly thought it was a blank, an experienced highly trained individual would know the difference immediately. a blank is simply a casing that's been hollowed out. it still has wax and paper and gun powder to simulate the action, the firing, the image of a real bullet coming out of a gun. if she didn't know the difference and alex baldwin hired a person who didn't know the difference, they could be criminally culpable. judge jeanine: the entire crew walked out according to several
6:24 pm
publications because they hadn't been paid in two weeks and there was poor gun safety. and they brought in non-union guys to replace us and called cops. if you have a 24-year-old armorer responsible for that gun safety. how does a bullet actually -- real bullet get into a prop gun, or were they using a real gun without a blank cartridge? then the issue becomes how did he point the gun at someone. on set you are taught not to point a gun at someone. >> using a blank with a real gun you must be at least 20 feet away. they will be look at that. but you bring up a good point about safety of workers. some of them walking off the set
6:25 pm
days earlier. there are three former co-workers who told the "new york times" on october 16, there were not one, but two zerntal discharges of guns. so that puts alex baldwin and everybody else associated with this production, not the least of which is the armorer on in the that there is a weapon safety issue that we lead to criminal culpability. because there was labor unrest. what if a disgruntled former employee slipped on to the set and swapped out a blank for a real bullet to harm somebody there? that would be murder. judge jeanine: at the same time her job is to make sure that doesn't happen before they bring it out. independent films sometimes they cut corners and try not to spend

6:31 pm
jenna: remember the other week when the national school boards association wrote a letter to biden likening american parents to domestic parents. they did a 180 saying there was no justification for some of the language in the letter. how about attorney general merrick garland will he apologize? is the attorney general so politically biased and so malleable that he will get a letter for which there is no basis in fact. then decide to deploy the fbi to go after parents of children in school? is this what we have for an attorney general? i don't care if he never apologizes. but has he? >> that's exactly what happened.
6:32 pm
he said so in the hearing this week. letter goes to president biden september 29 asking for the president to get involved in local school board members. five days later the attorney general of the united states does just that. his only basis for doing that was this letter from the left wing national school boards association. and what did they do? they pregreat and apologize for the letter. the logical thing to do would be for him to rescind this letter. it looks like the school board association was coordinating the white house before they certain the letter on the 29th. and god bless these moms and dads who mad the courage to go to school and say we don't want this racist anti-american curriculum taught to your
6:33 pm
children. it god bless these parents. >> how can the american people trust this administration, trust this attorney general when they use as a reason to call parents in the united states of america domestic terrorists. they use a guy whose daughter was forcibly raped and sound miced in a bathroom by a boy who wore a skirt and decide he should use the bathroom. the superintendent gets up and said we don't have any crime like that. this is the father of the girl who was raped trying to talk at the meeting and look what they do to him. this is not the united states of america anymore. what is going on? >> i said this in the hearing thursday. i think his memo, this memo he sent out is the last straw. this will be a catalyst for a reawakening and focus on freedom
6:34 pm
in this country. i think that's why the school board association said we re-regret we sent this letter. they were hearing from parents, they are hearing from them and they those wait a minute, we better back down. plus the good work you did at fox news and other conservative outlets talking about this helped as well. this is a good sign to see they are apoll jiegs for this letter. let's see what the attorney general does. i hope they will say, we were wrong. we'll have to wait and see. judge jeanine: if he doesn't, the biden administration will pay a price. they have awakened a sleeping giant. as violent crime destroying our cities. the bind administration continues to let fentanyl in

>> i guess i should go down. but the point of it is i haven't had a whole hell of a lot of time to get down. i have been going around look at the billions of dollars caused by hurricanes, floods and weather, and traveling around the world. judge jeanine: that's joe in his own word saying he can't make time for the border. really? he may want to rethink that as we face a catastrophic number of migrants coming into the country and fentanyl killing americans at an alarming and increasing rate.
6:40 pm
joining us derek maltz joins us on this critical story. this week in san francisco. police seized enough fentanyl to kill 2.8 million people. what is going on with fentanyl. how is it getting into the country, and how is it changing if at all? >> we have a tsunami of deadly fentanyl coming into the country every day. the chinese are working with the cartels to get fentanyl into our country. we have deadly fentanyl pills, fentanyl mixed with cocaine and heroin. our future generation is being killed. we have 12-year-olds going online buying these fake pills and they are dying in their bedrooms. judge jeanine: the fentanyl is
6:41 pm
in mexico. then they put an imprint on the pills so the kids thing they are getting oxycontin. so it looks like it's legitimate and it's being brought into the united states. >> the mexican cartels want to make billions of dollars. that's what they are doing. now because of the migrant crisis they have an unlimited cash flow. the chinese criminals want to kill us and destabilize our country. they are providing the chemicals coming in from these chinese wuhan-style labs. the cartels are making so much money because the fentanyl is very addictive. the kids are getting addicted. every kid wants a xanax.
6:42 pm
these are not overdose deaths anymore. these are fentanyl murder and drug induced homicide and poisoning. judge jeanine: fentanyl has increased. what percentage of the pills people are buying its counterfeit from china through mexico? >> chien always providing -- china is providing the precursor chemicals. and they are buying the pill presses and the dyes on these different social media sites and the internet and making the pills in our backyard. the dea seized 9.5 million pills. 40% of those pills had a lethal dose of fentanyl. one pound of fentanyl can kill
6:43 pm
227,000 people. that's why it is a weapon of mass destruction. we are under a chemical attack and china is destabilizing our country. the parents need a warning. kids don't understand what fentanyl is. nobody is talking about it. judge jeanine: this is called unrestricted warfare. >> this is what the experts that understand the communist chinese party. they want to destabilize their adversary. america is a strong adversary, economic powerhouse. they want to sit back and let the cartels do the dirty works. 100,000 died. the cdc put out the stats. 99,000 under the provisional death data. that's how many americans are dying. this is something we have never seen in the history of the

>> my guess is you will start to see gas prices come down as we get by and going into the winter -- excuse me the next year 2022. i don't see anything that will happen in the meantime that will significantly reduce gas prices. judge jeanine: gas prices in america have surpassed well over $7. the west wing is a whirlwind of confusion with a clueless president. joining me is tomi lahren and leo terrell. gas prices for regular unleaded sit $7.59 in one california
6:49 pm
town. >> this is what happens when you spend billions of dollars on environmental justice and tree equity. joe biden is what you get when you order your president, vote by mail. all this can be explained in the first hours of his administration. he's prioritizing climate change. that's why we are seeing gas prices go through the roof. this is the california model nationalized. he doesn't seem to care. when is the last time anyone let joe biden drive a car. judge jeanine: go ahead, leo. >> this is a self-inflicted wound. this did not have to happen. biden changedder one of donald trump's energy policies. we were energy independent. we didn't need foreign oil. for joe biden to say this is going to continue, it never had
6:50 pm
to happen. i'm in that state where there is gasoline, $7.50 for regular. $8.50 for premium. this is because the biden administration can't stand to give trump credit for what he did. we were energy independent. we didn't need foreign oil. that's why the gasoline prices are rising. judge jeanine: he said i can apartment oil reserve but it will probably only save 18 cents a gallon. let's talk about the fact that rising gas prices are a major problem. we have a full screen on that. 67% of the country say it's a major problem. the pain at the pump with biden saying i don't have a near term

tonight we close with hypocrisy. is this week we watched as joe biden and his wife emerge from a washington d.c. restaurant without a mask. fox news medical contributor, doctor marc siegel joyously to talk about it. let's talk about the hypocrisy of a ddc recommending wearing mask even if they are vaccinated. what is going on? >> they are focusing on the wrong thing because they should focus on the i get the vaccine works and if kids take the vaccine, less likely to spread it and they need to get more testing at home so you know if
6:57 pm
you have covid or not and let's make sure teachers get vaccinated. people spreading it right now in schools are really young children not getting vaccinated. bringing kids together doesn't help, fast or no mask so they've got to be practical. it's not like you go to the back of the room and you win, we know it's worth that's not the way to teach, is it? teaching, learning, exchanging. instead, the idea of the rule, that's with the biden administration is using, the ruler on kids. that's getting nowhere. >> the mandates don't work so why are we masking kids? they want to vaccinate them and mask them. it's a negative influence on their psychological health, their emotional health and social well-being, what is this about? >> it sends the wrong message, it's always going to be us scrolling scalding and bowling you and telling you what to do.
6:58 pm
i think once you are vaccinated, your chances of spreading this are low especially -- again, there could be exceptions where kids are really close together in schools but masks are know and what we are seeing is victim after victim which doesn't work, it backfires and there's rebellions and threats and then counter threats judge comes in and says there's lawsuit. we need public health, vaccine and testing and mask if you're unvaccinated course quarters. >> everybody knows kids go to school in the fall, it's flu season. kids always come home with the flu and all of a sudden we've got to force them to take the vaccine. can i tell you how many people i know who say if they require me to vaccinate my child, i don't want to do it. my child is not going to get it. >> i want to talk about that because they are going to end up approving in the next couple week for five to 11 euros i

spoke to the chief science officer for the coven response team he looked at the data and says it looks good in terms of safety but here's the thing, this belongs in the pediatrician's office that doctor like me, are slow needles that doesn't scare kids, a parent and a child making a decision, not a victim, not a mandate, it's not going to work, it's a one on one decision with the child of the parent and the doctor. >> this week the mayor in new york city said he was disturbed by a video of massless crops dealing with a man out of the subway station and out of an interview demand better questions -- they are so hypocritical on the left. we've got police like first responders saving us and they fire them if they don't get
7:00 pm
vaccinated. where is this going? >> contrast that with what you started with, the mayor of chicago out of crowded basketball game, no mask and then you have the president of the united states in d.c. with a mask mandate not wearing a mask. >> doctor, thank you so much. that's it for us tonight, forget to set your dvr. ♪♪ dan: unfortunately we are listening to america. one protected class on the left and the other is second-class citizens. that's us. i'll breakdown the rules on conservatives and how it would be. then joe biden's numbers in the tank. we are getting clear about what americans are worried about, it's not white rage. plus chinese showing off new supersonic missile system and the biden administration
