accidentally... >> sean: earlier today baldwin broke his silence. posted on twitter, no words to convey my shock and sadness regarding the tragic accident that took the life of helena hutchinson. a wife, mother, deeply admired colleague of ours, added that he's fully cooperating with the police investigation. a story breaking from "the "l.a. times"" finds that hours before the strategy, half a dozen crewmembers walked off the set in protest of working conditions. detectives currently are investigating how and what type of projectile was discharged. no charges have been filed at this here with reaction, fox news correspondent at large geraldo rivera, and fox's legal analyst gregg jarrett. geraldo, letar me start with yo. the wars between me and alec baldwin do not factor in my opinion here. i want to be straightforward. i would be shocked if thes evidence shows that in fact he did this on purpose.

i don't believe that. i do not think we are going to come to that conclusion. i believe in due process. the presumption of innocence. i believe we need a full forensic investigation. in my heart, it seems like, looks like a tragic accident. intoid a live round get that weapon? it's really a gun supposed to fire blanks. >> wright, sean. but when the live round comes a later verified that by live weren't saying that it was a bullet, it could have been a blank. when you fire a blank, it leaves a residue in the barrel of the gun. we know guns very well. if you don't clean the barrel out, you put another blank behind it and you fire that blank, it can eject that projectile. the remnants of what was in the barrel at sufficient velocity, it is bullet-like. you mentioned charges. let me just say that this was just a tragic accident with the

background of this labor turmoil and chaos on the set. listen to this definition of involuntary manslaughter. it involves a killing that occurs when the defendant is engaging in a lawful but dangerous act without exercising due caution and circumspection. the example they gave is the driver who is texting and accidentally kill somebody. involuntary manslaughter is a fourth degree felony in new mexico punishable by up to 18 months in prison. this is very serious. this is at the minimum they spent on the in the fourth degree,ny this is what alec baldwin or the props guy or girl may be facing, sean. >> sean: listen very carefully. lawful but dangerous act without using due caution. i'm listening to those words carefully. i will pick you a legal mindur here. would it be the actors role to take a prop gun and say, excuse

me, can you assure me that this is a blank and not a bullet? >> it's not his role. if there is no evidence that he knew there was a real bullet gun, he would not be criminally charged. unless it can be shown, sean, he was mishandling the gun in a grossly negligent or reckless way. the information we have doesn't indicate that but law enforcement continues to investigate. there will be a civil lawsuit for moneyy damages alleging negligence, almost a given. this sort of thing shouldn't happen. there are standards, safety protocols in place on film sets involving licensed armorers who are there to provide, handle, maintain, check, and double check, and secure the weapons and nobody else has access to ia
